The Fisheries (Karekare Beach Shellfish Closed Season) Notice 1995 (No. 5408)

Pursuant to section 85 of the Fisheries Act 1983, the Director-General of Agriculture and Fisheries, after consultation with the Director-General of Conservation, the New Zealand Fishing Industry Board and the Treaty of Waitangi Fisheries Commission, pursuant to sections 85 and 86 of the Fisheries Act 1983, hereby gives the following notice.

Notice

  1. Title and commencement—This notice may be cited as the Fisheries (Karekare Beach Shellfish Closed Season) Notice 1995 and shall come into force on the 2nd day of May 1995.

  2. Interpretation—In this notice, the term:
    “Shellfish” has the meaning given in the Fisheries Act 1983;
    “Karekare Beach Shellfish Area” means all those waters lying within an area bounded by a line commencing at the southern end of Karekau Point (at 36° 59.8' S and 174° 28.4' E); thence proceeding generally in a westerly direction to the southern end of Paratahi Island (at 36° 59.8' S and 174° 28.2' E); thence generally in a northern direction to Farley Point (at 36° 59.2' S and 174° 28.1' E); thence generally in a southerly direction along the mean high-water mark to the point of commencement.

  3. Closed season for shellfish determined—There is hereby determined to be a closed season for the taking of all shellfish within the Karekare Beach Shellfish Area commencing on the 2nd day of May 1995, and expiring on the 1st day of May 1998.

Dumping and Countervailing Duties Act 1988

Initiation of Dumping Investigation: Abrasive Discs and Wheels From Korea and Taiwan

Notice is hereby given that, acting pursuant to section 10 (1) of the Dumping and Countervailing Duties Act 1988, and under delegated authority from the Secretary of Commerce, I have initiated an investigation to determine both the existence and effect of the alleged dumping of the goods described and from the countries of origin specified in the Schedule to this notice, being satisfied that sufficient evidence has been provided that:

(a) The goods imported or intended to be imported into New Zealand are being dumped; and

(b) By reason thereof material injury to an industry has been or is being caused,

and also being satisfied that the collective output of those New Zealand producers who have, in writing, expressed support for the application constitutes—

(c) Twenty-five percent or more of the total New Zealand production of like goods produced for domestic consumption (assessed during the most recent representative period, being not less than 6 months); and

(d) More than 50 percent of the total production of like goods produced for domestic consumption (as so assessed) by those New Zealand producers who have, in writing, expressed support for or opposition to the application.

Description of Goods
Phenolic resin bonded reinforced agglomerated abrasives (excluding agglomerated diamond abrasives of either natural or synthetic form), of the following types and dimensions:

— Grinding discs or wheels with diameters up to 230 mm and thicknesses up to 10 mm;

— Cut off wheels or discs with diameters up to 409 mm.

The goods are currently classified under Tariff Item and Statistical Key 6804.22.00 01B of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.
