Amending a Notice Stopping Road in Rotorua District

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton, hereby amends the notice, dated the 10th day of November 1994, and published in the New Zealand Gazette of 17 November 1994, No. 121, at page 3577, stopping road in Rotorua District, by deleting in the recital “memoranda of mortgage B. 081179.3 and B. 081179.4” and substituting “memorandum of mortgage B. 081179.3”.

Amending a Declaration Declaring Stopped Road and Land Taken in Otamatea County to be Vested

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, amends the declaration dated the 5th day of September 1989, published in the New Zealand Gazette of the 14th day of September 1989, No. 159 at page 4255, declaring portions of stopped road and land taken in Otamatea County, pursuant to section 117 of the Public Works Act 1981 by:

Firstly: Deleting from the heading the words “to be vested in Otamatea County” and substituting therefore the words “in Kaipara District to be vested”.

Secondly: Deleting from paragraph i of the operative clause the words “memorandum of mortgage 655395.5 and B. 137028.1, statutory land charges 902198.1 and B. 196636.1 and memorandum of priority B. 137028.2, North Auckland Land Registry” and substituting therefore the words “all encumbrances lodged on the certificate of title on the date of registration of this notice in the Land Registry Office”.

Thirdly: Deleting from paragraph ii of the operative clause the words “building line restriction contained in K45636, memoranda of mortgage A9832, 655395.5, B. 463212.2 and B. 724726.2, statutory land charges 902198.1 and B. 196636.1, Gazette notice 912103.1 and memorandum of priority B. 724726.3, North Auckland Land Registry” and substituting therefore the words “all encumbrances registered on the certificate of title on the date of registration of this notice in the Land Registry Office”.
