Charitable Trusts Act Notices

In the matter of the Charitable Trusts Act 1957, and in the matter of the charitable will trust of Lindsay Sangster Rogers, late of Te Awamutu (deceased):

Take notice that at 2.15 o’clock on the afternoon of the 19th day of May 1995, pursuant to Part III of the above-mentioned Act, the trustees of the Te Awamutu College will apply to the High Court at Hamilton for an order approving a scheme varying the trust declared by the will of Lindsay Sangster, late of Te Awamutu, deceased, by enabling the residuary estate of the said Lindsay Sangster Rogers being transferred to a separate charitable trust known as The Te Awamutu College (Rogers) Charitable Trust, such trust having power to apply both the capital and the income thereof for the the provision of land educational courses for pupils attending Te Awamutu College, the provision of assistance by way of bursaries, scholarships, boarding fees or expenses to assist pupils attending or desirous of attending Te Awamutu College and the erection or contribution to the erection of such hostel or hostels or other boarding establishments as the trustees may think fit to provide accommodation for pupils attending Te Awamutu College.

A copy of the said scheme may be inspected at the offices of Gallie Miles, Solicitors, 135 Roche Street, Te Awamutu.

Any person desiring to oppose the said scheme shall give written notice of his or her intention so to do to the Registrar of the High Court at Hamilton, to Her Majesty’s Attorney-General, care of the Crown Law Office, P.O. Box 5012, Wellington, to the trustees of the Te Awamutu College, care of the above-mentioned firm of solicitors, not less than 7 clear days before the first above-mentioned date appointed for the hearing of this application.

Notice of Application for Approval of a Scheme

Pursuant to Part III of the Charitable Trusts Act 1957

In the High Court of New Zealand, Dunedin Registry

Under the Charitable Trusts Act 1957, and in the matter of the “Ross Memorial Fund”, created by deed of settlement on 31 July 1946, and in the matter of an application by John Fergus Ross of Dunedin, retired manager, Donald Inkster Ross of Wanaka, retired manager, Peter Michael Stapleton of Dunedin, marketing manager and Albert Norman Ritchie of Christchurch, accountant, as trustees of the said fund for the approval of a scheme under Part III of the said Act.

Notice is hereby given that John Fergus Ross of Dunedin, retired manager, Donald Inkster Ross of Wanaka, retired manager, Peter Michael Stapleton of Dunedin, marketing manager and Albert Norman Ritchie of Christchurch, accountant, as trustees of the “Ross Memorial Fund” have filed in the High Court at Dunedin, an application for approval of a scheme. The proposed scheme would vary the manner of disposition of the income of the said fund and vary the mode of administering the fund. Under the proposed scheme the net income of the trust fund would in summary be held for the following purposes:

  1. For charitable purposes among employees and erstwhile employees and the dependents thereof of Ross Glendining Limited in the discretion of the trustees as to manner, share and extent.

  2. Any residue of net income then remaining for care, recreation and recovery of needy residents of Ross Home, Dunedin in the discretion of the trustees as to manner, share and extent.

  3. Any residue of income then remaining may at the discretion of the trustees be paid to Presbyterian Support Services (Otago) for charitable purposes.

  4. Any residue of net income then remaining shall be accumulated and added to the capital.

Other proposed changes to the trust are in summary as follows:

  1. The restriction on who may be trustee is removed and Trustees Executors and Agency of New Zealand shall be trustee and William Thomas Fergus Ross, shall be an advisory trustee.
