District Courts Act 1947

Acting District Court Judge Appointed

Pursuant to section 10A of the District Courts Act 1947, Her Excellency the Governor-General has been pleased to appoint

Phillip Terence Rice, retired District Court Judge

to be an Acting District Court Judge, to exercise civil and criminal jurisdiction at such place or places and for such period or periods only as the Chief District Court Judge may fix, pursuant to the said section 10A of the District Courts Act 1947, for a term of 12 months on and from the date hereof.

Dear Professor Axford

In accordance with section 8A of the Foundation for Research, Science and Technology Act 1990, I direct the Foundation for Research, Science and Technology to allocate funds under the Ministerial Scheme “The Marsden Fund”.

The scheme is intended to support excellent research and researchers, regardless of whether or not the research contributes to Government’s socio-economic priorities.

Annex I details the specific nature, objectives, criteria, and funding levels applying to the scheme, and nominates the Ministry of Research, Science and Technology as the agency that is to monitor the scheme. Without prejudice to long term arrangements, the Annex sets a period to 31 December 1996 for the term of this Instruction. Prior to the expiry of that term but otherwise as soon as is practicable, I will determine the long term arrangements for the management of the Marsden Fund. These long term arrangements will apply as from the expiry of the present Instruction.

The Foundation is to report to me on the operation of the scheme within two months of the end of each financial year. The report will review the allocations made under the scheme for that year including factors such as amount and duration of awards, host institutions or enterprises, and category of research. The nature of unsuccessful proposals should be commented on.

Monitoring by the Ministry of Research, Science and Technology is to comprise a commentary on the reports provided by the Foundation.

In accordance with the Foundation for Research, Science and Technology Act 1990 this notice will be published in the Gazette and a copy laid before the House of Representatives.

MINISTERIAL INSTRUCTION: THE MARSDEN FUND

Term of instruction

This instruction will remain in force until 31 December 1996.

Nature and Objectives of the Scheme

The objectives of the scheme are;

  • to enhance the underpinning scientific knowledge-base in New Zealand; and
  • to broaden and deepen the research skill-base in New Zealand.

The Marsden Fund has been established to support excellent research and researchers, and to enhance the quality of the research environment by creating increased opportunity to undertake research that is purely curiosity-driven. The Marsden Fund complements the Public Good Science Fund (PGSF) and in so doing is not expected to fund research which is clearly more appropriate to the PGSF.

In supporting excellent research “for its own sake”, the Government is ensuring that New Zealand is contributing to, and benefiting from, the advancement of knowledge globally, and is laying the foundations for strategically-oriented research of direct benefit to New Zealand. This scheme also provides for the long-term and sometimes random aspects of research, which may lead to profound or unexpected discoveries, or catalyse significant developments in previously unrelated and strategically important fields of science.

Access to the Fund

The Marsden Fund is to be operated as a contestable fund. Eligibility to bid to the fund is unrestricted provided that the research proposed is either to be carried out in New Zealand or, if its nature demands that it be carried out elsewhere, by New Zealand based researchers. Researchers who have submitted proposals to, or have been funded from, the Public Good Science Fund or other sources, are not precluded from submitting separate proposals to the Marsden Fund. However, appropriate procedures are to be implemented by the Foundation to ensure that double-funding of a single piece of work does not occur.

PGSF Output 34/36 Contracts

Commitments made by the Foundation to fund in 1995/96 programmes formerly in Outputs 34 and 36 of the PGSF and which have by agreement been transferred to the Marsden Fund, will be honoured.

Types of proposals supported

Funds are to be allocated for the support of research projects or programmes, or for the support of individual researchers, including post-doctoral fellows, consistent with the objectives of the Scheme and the criteria set out in the following sub-section. While the funding for the Scheme remains relatively small in the first year of operation, postgraduate students will be supported only as a component of a larger programme. Individual postgraduate scholarships will not be made available at this stage.

Attention is to be given to both supporting major programmes of research of substantial significance involving teams of scientists, and the funding of individual scientists.

Costing of proposals

All projects or programmes must be fully costed. All or part of this cost may be sought from the Marsden Fund. Where only part of the cost is sought, other sources of funding, including other Crown funding and, where appropriate, the components of the research being supported, must be identified.
