Notice (6) of Approval of Financial Reporting Standard

Notice is hereby given, pursuant to section 29 of the Financial Reporting Act 1993 ("the Act"), that the Accounting Standards Review Board has approved, for the purposes of the Act, Financial Reporting Standard No. 13, "Accounting for Research and Development Activities".

FRS-13 is to apply to all reporting entities, the Crown and all departments, offices of Parliament and Crown entities (each of which is defined in the Act) other than those that are expressly exempted by the terms of the standard for application to accounting periods and interim accounting periods that end on or after 30 September 1995.

Treaty of Waitangi Act 1975

Application to Exempt Land

This notice concerns a property comprising approximately 787 square metres situated at 27 Takitimu Street, Orakei, Auckland and Maori claims under the Treaty of Waitangi Act 1975.

The land at 27 Takitimu Street, Orakei, Auckland is described in legal terms as:

All that parcel of land containing 787 square metres, more or less, situated in the City of Auckland, being Lot 86, Deposited Plan 37692, Block IX, Rangitoto Survey District and being all that land comprised and described in certificate of title 85A/268, North Auckland Registry.

Subject to:

(1) Section 3 of the Petroleum Act 1937, section 8 of the Atomic Energy Act 1945, Section 3 of the Geothermal Energy Act 1953, sections 6 and 8 of the Mining Act 1971 and sections 5 and 261 of the Coal Mines Act 1979.

(2) Part IVA of the Conservation Act 1987.

(3) Section 27A of the State Owned Enterprises Act 1986.

(4) Mortgage C. 558738.2.

The land was once owned by the Crown. It was transferred to a State Owned Enterprise under section 23 of the State-Owned Enterprises Act 1986.

There is a special notice or "memorial" on the certificate of title for the land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Maori ownership (see sections 27A and 27B of the State-Owned Enterprises Act 1986).

The current owners of the land, Nynehead Holdings Limited have applied to the Waitangi Tribunal to have this notice removed. This has been done under section 8D of the Treaty of Waitangi Act 1975.

ANY MAORI PERSON WHO CONSIDERS THAT THEY, OR ANY GROUP WHICH THEY BELONG TO, HAS A CLAIM TO MAKE TO THE WAITANGI TRIBUNAL ABOUT THIS LAND, SHOULD SUBMIT THEIR CLAIM TO THE WAITANGI TRIBUNAL BEFORE THE 1ST DAY OF JUNE 1995.
