has been approved to use forms for the purposes of the indicative referendum petitions; and

that the wording of the specific questions to be put to electors in the proposed indicative referendum is—

"Should all New Zealanders have access to comprehensive health services which are fully government funded and without user charges?"

"Should all New Zealanders have access to public education services, from early childhood to tertiary level, which are fully government funded and without user charges?"

"Should full employment with wages and conditions that are fair and equitable be the primary goal of government economic policy?"

"Should all New Zealanders on income support and benefits get an income based on what it actually costs to live?"

"Should all increases in New Zealand’s electricity demand be met from energy conservation and from the use of sources that are environmentally sustainable?"

"Should New Zealand’s defence expenditure be reduced to half its 1994/95 level by the year 2000 with the savings spent on health, education, conservation and the promotion of full employment?"

Fisheries Act 1983

Fisheries (Bycatch Trade-off) Notice (No. 1) 1995 (No. 5399)

Pursuant to section 28ZG of the Fisheries Act 1983, and a delegation made pursuant to section 41 of the State Sector Act 1988, the Regional Manager Fisheries Advisory and Research Services (North) hereby gives the following notice.

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Bycatch Trade-off) Notice (No. 1) 1995.

(2) This notice shall come into effect on the 23rd day of February 1995, and shall expire on the 15th day of April 1995.

  1. Interpretation—In this notice:

(a) Any reference to Quota Management Area means the appropriate Quota Management Area as defined in the Fisheries (Quota Management Areas, Total Allowable Catches and Catch History) Notice 1986*;

(b) Target species and bycatch species are specified by the way of fishstock codes, being Fishstock Codes defined in the Second Schedule of the Fisheries (Reporting) Regulations 1990†; and

(c) Methods are specified by way of method codes, being Method Codes defined in the Second Schedule of the Fisheries (Reporting) Regulations 1990†.

  1. Offering a lease of quota in lieu of paying deemed value—(1) As from the date this notice comes into effect, any commercial fisherman who could be required under section 28ZD of the Fisheries Act 1983 to pay the deemed value of any fish that is specified as a bycatch species in this notice, may offer the Director-General a lease or sub-lease of the right to take fish, being fish that are specified in this notice as a target species in relation to that bycatch species, as specified in the tables below.

(2) The ratios, as specified, are the amounts of target species which may, in lieu of such payments, be accepted by way of lease or sub-lease in relation to the amount of the bycatch species for which the offer of quota is made, e.g. if a fisher could be required to pay deemed value for 1 tonne of GUR 1 and wishes to offer a lease of FLA 1 then the amount that can be offered is 1 tonne × 0.42 = 0.42 tonnes of FLA 1.

(3) The bycatch species must have been taken while fishing for the target species using the method or any of the methods specified; e.g. in the case of the above example, the GUR 1 bycatch must have been taken using the method of setnetting.

(4) Any offers that relate to bycatch species as specified in this notice must relate to fishing that has occurred in the months of February or March 1995 respectively.

  1. Revocation—(1) The Fisheries (Bycatch Trade-off) Notice (No. 4) 1994 (No. 5358) appearing in the New Zealand Gazette on 21 July 1994, No. 73 at page 2340 is hereby revoked.

(2) The Fisheries (Bycatch Trade-off) Notice (No. 6) 1994 (No. 5369) appearing in the New Zealand Gazette on 11 August 1994, No. 81 at page 2527 is hereby revoked.
