EJ Drake Trust
Notice of Application for an Order Approving Scheme
Under Part III of the Charitable Trusts Act 1957
Notice is hereby given that the EJ Drake Trust Board has applied to the High Court at Auckland for an order approving a scheme under Part III of the Charitable Trusts Act 1957, to vary the terms of the will of Edward John Drake, farmer of Auckland, and a deed of charitable trust under which the EJ Drake Trust (being the deceased’s residuary estate) is held.
Under the proposed amended will and amended deed of charitable trust, the EJ Drake Trust Board will be empowered to apply the capital fund of the EJ Drake Trust and the whole or any part of income arising from the EJ Drake Trust in the provision, construction, maintenance and upkeep of any buildings forming or to form part of the West Auckland Area Returned Services Association Home for the Elderly and shall make payments for these purposes to the West Auckland Area Returned Services Association Home for the Elderly Trust.
The date for the hearing of this application is Friday, the 2nd day of February 1996 at the High Court at Auckland at 10.30 a.m.
The application and supporting documentation may be viewed at:
- The High Court, Auckland, 9 a.m.–4 p.m., Monday to Friday; or
- The offices of Earl Kent, Solicitors.
Any person desiring to oppose the scheme for variation of the will and of the deed of charitable trust must give written notice of that intention, at least 7 clear days before the hearing.
Such written notice must be served upon:
- The Registrar, High Court, Auckland;
- The EJ Drake Trust Board, care of its solicitors, Earl Kent, Fourteenth Floor, Quay Tower, 29 Customs Street, Auckland (P.O. Box 222, Auckland); and
- The Attorney-General, care of Crown Law Office, 45 Pipitea Street, Wellington (P.O. Box 5012, Wellington).
