Easement Acquired to Drain Water for Stormwater Disposal Purposes—Kent Terrace, Napier City

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Department of Survey and Land Information, Napier, declares an agreement to that effect having been entered into, the following easement is acquired as an easement in gross to drain water for stormwater disposal purposes and shall vest in The Napier City Council on the date of publication in the New Zealand Gazette. The easement may be surrendered at any time by notice published in the New Zealand Gazette.

Easement

A right to drain water over that part of the land described in the Schedule shown marked “E” on S.O. 10625, held in the office of the Chief Surveyor at Napier. Such grant being in accordance with Clauses 3 and 5 of the Seventh Schedule to the Land Transfer Act 1952, provided that the council (or its successor) shall at its expense maintain such drain in good and substantial repair.
