Dumping and Countervailing Duties Act 1988

Final Determination: Abrasive Discs and Wheels From Korea and Taiwan

Notice is hereby given that, acting pursuant to section 13 of the Dumping and Countervailing Duties Act 1988 (hereinafter referred to as “the Act”), I have made a final determination that, in relation to the goods specified in the First Schedule to this notice (hereinafter referred to as “the subject goods”), imported or intended to be imported into New Zealand—

(a) The subject goods are being dumped; and

(b) By reason thereof material injury to the New Zealand abrasive discs and wheels industry has been and is being caused.

Notice is also hereby given that, acting pursuant to sub-sections 14 (1) and 14 (4) of the Act, I have determined the rates of anti-dumping duty to be imposed on the subject goods to be the rates set out in the Second Schedule to this notice.

FIRST SCHEDULE

Goods Subject To Determination

Countries of Origin
Korea and Taiwan.

Description of Goods
Phenolic resin bonded reinforced agglomerated abrasives (excluding agglomerated diamond abrasives of either natural or synthetic form), of the following types and dimensions:

— Grinding discs or wheels with diameters up to 230 mm and thicknesses up to 10 mm;

— Cut off wheels or discs with diameters up to 409 mm.

The goods are currently classified under Tariff Item and Statistical Key 6804.22.00 05E of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

SECOND SCHEDULE

Rate of Anti-Dumping Duty
The rate of anti-dumping duty to be paid in respect of subject goods imported or intended to be imported from the producers listed below, shall be the rate specified below in respect of that producer, calculated as a percentage of the declared value for duty of the subject goods:
