Jeff Farm Trust

Notice of Application for Variation

Pursuant to the Charitable Trusts Act 1957

The Salvation Army Property (New Zealand) Trust Board (“the trustee”) has filed in the High Court at Invercargill, an application seeking an order from the Court that a scheme varying the terms of a deed of trust made between Edmund Sanderson Jeff, then of Otarai, Southland, sheep farmer but now deceased and the trustee (“the trust deed”) be approved.

The application is to be heard in the High Court at Invercargill on 20 November 1995 at 10.00 a.m.

The trust owns certain properties situated in the Dunedin and Invercargill registries. The trust deed requires that the properties be used, where practical, as a farming business and to hold the net annual income upon trust. Half of such money is to be used in any farm training establishment conducted by the Salvation Army in New Zealand and the other half is for the development of the farm.

Since the inception of the Jeff Farm Trust the trustee has conducted a sheep farm. A considerable investment was initially required as the farm was in poor condition. Since about 1980, however the farm has produced very well indeed and has returned good profits.

Prior to 1981, very little was accomplished with the training of young people on the farm, though efforts had been made to attract young people. From 1981 to 1986 only 7 young people were employed and living at the farm. Few underprivileged youths from the city have shown interest in undertaking farm training in isolated areas.

Pursuant to the Children Young Person and their Families Act 1989, the environment provided by Jeff Farm, in housing underprivileged children and youths, is now no longer consistent with contemporary social policy.

The trustee seeks to amend the trust deed to enable the profits accumulating from the farm to provide:

  1. Assistance to young people with travel to, accommodation and education for any aspects of farming with priority being granted to underprivileged youths, youths who would not otherwise have the opportunity and youths who would be benefited by such assistance.

  2. Funds by way of grant to the farm training institutions.

  3. Therapy and training offered in Salvation Army breach programmes for chemical substance abusers.

  4. The adventure based training programme.

  5. The camping programmes run by the Salvation Army in their youth camps.

  6. Selected training modules associated with the employment programmes run by the trustee particularly those specifically related to underprivileged young people where rural and outdoor related skills such as farming, horticulture and forestry are taught.

  7. For the creation of training and learning opportunities for underprivileged young people in the care of the trustee in inner urban areas.

  8. Supervision and ongoing support for young people referred to in trustee through the Courts and the diversion scheme.

  9. To establish and/or provide financial assistance to any person or organisation establishing and/or conducting establishments for the use of Bible classes, youth groups, children’s homes and other organised bodies belonging to any Christian denomination for holidays and/or retreats.

Any person intending to oppose this application must give written notice of their intention to do so to the Registrar, the Salvation Army and the Attorney-General on or before the 13th day of November 1995.
