the charge if the defendant proves that the speargun or pointed missile in the defendant’s possession or under the defendant’s control was not used in the taking of the sports fish.
(3) In this clause the term ‘’explosive’’ has the same meaning as in the Explosives Act 1957.

Authorised lures and baits—No licence holder shall fish for sports fish with any bait or lure other than artificial or natural fly, insect, worm, crustacea, minnow, fish (excluding fish ova or any portion of a fish or any shellfish (mollusca)) or uncoloured bread dough.

Daily limit bag—No licence holder shall on any one day kill or be in possession of more than 10 trout.

Minimum size to be taken—(1) No licence holder shall be in possession of any trout which does not exceed 30 cm in length.
(2) Every licence holder taking trout which does not exceed the specified length shall immediately return it with as little injury as possible into the water from which it was taken.
- Revocation—The notice published in the supplement to the Gazette, No. 151, of Friday, 31 August 1990, on page 3202 titled District Anglers (Northland Fish and Game Region) Notice 1990, and Amendment No. 1, are hereby revoked.

District Anglers (Taranaki Fish and Game Region) Notice 1994
Pursuant to section 26R (3) of the Conservation Act 1987, the Taranaki Fish and Game Council hereby gives the following District Anglers Notice.
Notice

Title and commencement—(1) This notice may be cited as the District Anglers (Taranaki Fish and Game Region) Notice 1994 and shall come into force on the 1st day of October 1994.

Interpretation—Words and expressions in this notice which are defined in the Conservation Act 1987, or the Freshwater Fisheries Regulations 1983, shall have the meaning so defined.

Open season—(1) Sports fish may only be taken from waters during the open season provided for those waters.
(2) In all waters except those listed below the open season shall be from the 1st day of October in any year to the 30th day of April in the following year (both days inclusive).
(3) In the waters known as:
(a) Lake Rotomanu;
(b) Lake Mangamahoe, excluding the Waiwhakaiho inlet;
(c) Opunake Lake;
(d) Ohakune Lake;
(e) Lake Rotokuru;
(f) Virginia Lake;
(g) Lake Namanu;
the open season shall be from the 1st day of October in any year to the 30th day of September in the following year (both days inclusive).
(4) In the waters known as:
(a) Manganuiateao River and its tributaries;
(b) Retaruke River and its tributaries;
(c) Tokiahuru River and its tributaries;
the open season shall be from the 1st day of October in any year to the 30th day of June in the following year (both days inclusive).
(d) Mangawhero River and its tributaries upstream from Kakatahi;
(e) Raetihi Hydro Dam;
the open season shall be from the 1st day of October in any year to the 30th day of June in the following year (both days inclusive).
(5) In the waters known as:
(a) Lake Rotorangi from the dam face to the Mangamingi ramp;
(b) Lake Ratapiko, except the inlet race;
(c) Waitara River downstream from the Manganui River confluence;
(d) Waiwhakaiho River downstream from the end of Rimu Street extension;
(e) Huatoki Stream downstream from Brois Street bridge;
(f) Stony (Hangatahua) River, Waiau River, Mangahuia Stream, Kaupokonui Stream, Waingongoro River, all downstream from the State Highway No. 45 bridges;
(g) Whanganui River (excluding tributaries) downstream from the boundary;
(h) All waters south of a line from Patea to the Wanganui-Mangawatea River confluence, to Kakatahi, and through Colliers Junction to the boundary; the open season shall be from the 1st day of October in any year to the 30th day of April in the following year (both days inclusive), then from the 10th day of June of the following year to the 30th day of September of that same year (both days inclusive).
(6) In the waters known as:
(a) Lake Wiritoa;
(b) Lake Pauri;
the open season shall be from the 1st day of October in any year to the 12th day of April in the following year (both days inclusive).
- Authorised Tackle—(1) No licence holder shall fish for, take or attempt to take, any sports fish except by using a rod and running line.
(2) Notwithstanding subclause (1) of this clause, when landing a sports fish, a hand-held landing net may be used to secure or land any such fish.
(3) No licence holder shall, in fishing for sports fish, have in his control, more than one assembled rod which shall be within 15 metres and under visual observation at all times.
(4) No licence holder shall use:
(a) More than 2 lures or hooks;
(b) Any double or treble pointed hook, or any multiple hook assembly;
(c) Any gaff or landing hook;
(d) Any hook having a gape greater than 13 mm, measured from the point of the hook to the nearest point of the shank;
(e) Any hand-line, stroke-hauling gear, spear gun, paravane, firearm, explosive, spear, net (excluding landing net), trap or any other unsportsmanlike device or gear;
(f) Any electric fishing gear, except for the purposes of scientific investigations or data collection;
(g) Any poison or medicinal or chemical compound other than a preparation used solely to float or sink a fly or line.
