Road Realignment in Hauraki District

Pursuant to Parts II and VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton:

(a) Pursuant to section 20, declares that an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for better utilisation and shall vest in The Hauraki District Council on the date of publication hereof in the New Zealand Gazette.

(b) Pursuant to section 114, declares the land described in the Second Schedule hereto, to be road and vested in The Hauraki District Council.

(c) Pursuant to section 116, declares the pieces of road described in the Third Schedule hereto, to be stopped.

(d) Pursuant to section 119, declares the land described in the Fourth Schedule hereto, to be taken.

(e) Pursuant to section 117, declares those pieces of stopped road firstly and secondly described, now known as Sections 1 and 2, S.O. 59079 respectively, to be amalgamated with the land in certificate of title, No. 30C/151, subject to memoranda of mortgage H. 419096.5 and B. 041103, South Auckland Land Registry.

(f) Pursuant to section 117, declares that piece of stopped road thirdly described, now known as Section 1, S.O. 59078, to be amalgamated with the land in certificate of title, Volume 391, folio 228, South Auckland Land Registry.

(g) Pursuant to section 118, declares that piece of stopped road fourthly described, now known as Section 2, S.O. 59078, to be an esplanade reserve, subject to the Reserves Act 1977, and vested in The Hauraki District Council.

(h) Pursuant to section 117, declares those pieces of stopped road fifthly and seventhly described, now known as Section 1, S.O. 59134 and Section 7, S.O. 59135 respectively, to be amalgamated with the land in certificate of title, Volume 174, folio 5, South Auckland Land Registry.

(i) Pursuant to section 117, declares that piece of stopped road sixthly described, now known as Section 2, S.O. 59134, to be amalgamated with the land in certificate of title, Volume 174, folio 8, South Auckland Land Registry.

(j) Pursuant to section 117, declares those pieces of stopped road eighthly and nintely described, now known as Sections 5 and 6, S.O. 59135 respectively, to be amalgamated with the land in certificate of title, Volume 174, folio 6, South Auckland Land Registry.

(k) Pursuant to section 117, declares those pieces of stopped road tenthly, eleventhly and twelfthly described, now known as Sections 2, 3 and 4, S.O. 59135 respectively, to be amalgamated with the land in certificate of title, Volume 174, folio 4, South Auckland Land Registry.

(l) Pursuant to section 117, declares those pieces of stopped road thirteenthly, fourteenthly, fifteenthly, sixteenthly and seventeenthly described, now known as Sections 3, 4, 5 and 6, S.O. 59134 and Section 2, S.O. 59774 respectively, to be amalgamated with the land in certificate of title, Volume 410, folio 136, South Auckland Land Registry.

(m) Pursuant to sections 117 and 119, declares the pieces of stopped road nineteenthly, twentiethly and twenty-secondly described, now known as Section 1, S.O. 59774, and Sections 1 and 8, S.O. 59135 respectively, the piece of stopped road eighteenthly described and the land taken, firstly, secondly and thirdly described, now known together as Section 7, S.O. 59134, the piece of stopped road twenty-firstly described and the land taken fourthly described, now known together as Section 9, S.O. 59135, to be amalgamated with the land in certificate of title, Volume 1437, folio 53, subject to memoranda of mortgage H. 918663.5 and H. 918663.6, South Auckland Land Registry.
