Dumping and Countervailing Duties Act 1988

Notice of Reassessment of Anti-Dumping Duty on Automotive Oil Filters From the U.S.A.

Pursuant to section 14 (3A) of the Dumping and Countervailing Duties Act 1988 (as inserted by subsection 10 (2) of the Dumping and Countervailing Duties Amendment Act 1990), the Minister of Commerce gives the following notice:

N o t i c e

  1. Title and commencement—(1) This notice may be cited as the Final Determination and Imposition of Anti-Dumping Duty: Automotive Oil Filters from the U.S.A.: Amendment No. 1.

(2) This notice shall be read with and be part of the notice dated 27 November 1992 and entitled “Final Determination and Imposition of Anti-Dumping Duty: Automotive Oil Filters from the U.S.A.” (hereinafter referred to as the principal notice).

(3) This notice shall take effect on the day after the date on which it is published in the New Zealand Gazette.

  1. Anti-dumping duty amended—The principal notice is hereby amended by revoking the Second Schedule and substituting the Second and Third Schedules set out in the Schedule to this notice.
  • Published in the New Zealand Gazette of 3 December 1992.

Second Schedule

Amount of Anti-Dumping Duty

The amount of anti-dumping duty to be paid in respect of the subject goods shall be:

“A. For types of subject goods from a supplier listed in the Third Schedule to this notice, in respect of which a Normal Value (Value for Duty Equivalent) amount* has been established by the Secretary of Commerce, the amount by which that Normal Value (Value for Duty Equivalent) exceeds the Value for Duty of those goods when entered for home consumption.

“B. For types of subject goods from a supplier listed in the Third Schedule to this notice, but in respect of which the Secretary has not established a Normal Value (Value for Duty Equivalent) amount, the rate of duty represented by the weighted average dumping margin established from the Normal Value (Value for Duty Equivalent) amounts that have been established for other types of the subject goods from that particular supplier.

“C. For subject goods from any other suppliers, a rate of duty being the highest weighted average dumping margin established under B.

*Customs New Zealand holds a list of the Normal Value (Value for Duty Equivalent) amounts for importations of types of the subject goods from the suppliers listed in the Third Schedule to this notice. These amounts are confidential to the suppliers concerned.

Explanatory Note

This note is not part of the notice, but is intended to explain the reason for the amendment.

The original determination envisaged that for suppliers other than those investigated and for other filters from the investigated suppliers, normal values (value for duty equivalents) would be established as a basis for duty.

This was indicated by the invitation in the explanatory note to the principal notice for suppliers to lodge requests, backed by the necessary supporting evidence, for the establishment of these values.

Since the original determination, Normal Value (Value for Duty Equivalent) amounts have been established for eight additional suppliers and further oil filters have been added to the Schedules relating to the suppliers investigated.

The Normal Value (Value for Duty Equivalent) is the sum of the Normal Value established by the Secretary of Commerce with any necessary adjustments made in accordance with section 4 (1) (a) of the Act in order to establish the Export Price.

The Customs Department will hold a list of the Normal Value (Value for Duty Equivalent) amounts for importation purposes for oil filters which the Secretary of Commerce has established from individual suppliers, details of the weighted average dumping margins for those suppliers and
