Revocation of a Reservation Over a Reserve Specifying the Manner of Disposal and How Proceeds of Sale Shall be Utilised

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator of the West Coast Conservancy of the Department of Conservation, hereby revokes the reservation as a reserve for recreation purposes over the land described in the Schedule hereto, and further, declares that the said land may be disposed of by The Buller District Council at current market value, the proceeds from any such sale to be paid into the council’s reserves accounts, such moneys to be used and applied in or towards the improvement of other reserves under the control of the council or in or towards the purchase of other land for reserves.

Nelson Land District—Buller District

132 square metres, more or less, being part Lot 68, D.P. 4335, shown as Lot 1 on L.T. Plan 16062, situated in Block III, Kawatiri Survey District. Part New Zealand Gazette, 1954, page 259.

Survey and Land Information

Public Works Act 1981

Declaring Land to be Road in Grey and Westland Districts

Pursuant to section 114 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, Hokitika, declares the land described in the First Schedule hereto, to be road and vested in The Grey District Council, and further declares the land described in the Second Schedule hereto, to be road and vested in The Westland District Council.

1500 Part Bed of Taramakau River; marked “C” on plan.

All situated in Block XII, Waimoa Survey District and marked as above mentioned on S.O. Plan 12107, lodged in the office of the Chief Surveyor at Hokitika.

Area m² Being
8900 Closed Road, part Reserve 68 and Crown land; marked “A” on plan.

Area m² Being
1500 Part Bed of Taramakau River; marked “B” on plan.

Land Acquired for Road in the Westland District

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, Hokitika, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired for road, which pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 6 and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.

Easement in Gross for Drainage Purposes—Napier District

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares an agreement to that effect having been entered into, the easement in gross described in Schedule hereto over the land in the Schedule is acquired for drainage purposes (and may be surrendered at any time by notice in the New Zealand Gazette) and shall vest in The Hawke’s Bay Regional Council (called the grantee) on the date of publication in the New Zealand Gazette.

Easement

The right to drain water over the land through an open drain including the right for the grantee and its agents to do the following over the land:

  1. To enter the land and to pass and repass at all times with or without machinery.
  2. To modify, maintain or reconstruct the drain and do all things necessary to maintain the same in an efficient state.
  3. To prohibit the erection of any structure on or over the drain without the prior consent of the Grantee.
  4. To exercise the within rights in a manner reasonably necessary to serve the purpose of the work.
