Advertisement of Application for Approval of Altering a Trust

Under the Charitable Trusts Act 1957, in the matter of a trust fund held by the University of Canterbury for the purposes of 2 scholarships known as The Don McKenzie University Scholarship and The McKenzie-Villers Primary Schools’ Scholarship which trust was established by the late Sir J. R. McKenzie during his lifetime:

Notice is hereby given, pursuant to section 36 of the Charitable Trusts Act 1957, that The University of Canterbury has applied to the High Court at Christchurch, for approval of a scheme altering the terms of disposition of a trust fund held by the University of Canterbury for the purposes of 2 scholarships known as The Don McKenzie University Scholarship and The McKenzie-Villers Primary Schools’ Scholarship which trust fund was established by the late Sir J. R. McKenzie during his lifetime. The Don McKenzie University Scholarship is a scholarship which is open to pupils of the Timaru Boys’ High School who wish to attend university. The scheme provides for the alteration of the terms of the scholarship, increasing the maximum amount payable for any award, providing for the extension of scholarships and for the granting of further scholarships, and altering the criteria for selection. The McKenzie-Villers Primary Schools’ Scholarship is at present open to boys attending public, primary or intermediate schools in the former Canterbury Education District who are born of British parents, the scholarship being applied towards schooling expenses at certain named Canterbury schools. The scheme removes the requirement for candidates to be born of British parents, increases the maximum value of awards, removes the requirement for candidates to sit an examination and substitutes a different process of selection and changes the identity of those on the board of selection. In both scholarships the power to alter the regulations is amended.

A copy of the said scheme has been deposited in and may be inspected at the Registry Office of the High Court at Christchurch. It is proposed that the application for approval be heard by the High Court at Christchurch on the 15th day of March 1994 at 2.15 pm. Any person desiring to oppose the said scheme is required to give written notice of his or her intention to do so to the Registrar of the said Court and to the University of Canterbury and to the Attorney General not less than 7 clear days before the date proposed for the hearing of the application.
