Regulation 29 of the Shipping (Radio) Regulations 1994

  1. Application—The International Code of Safety for High Speed Craft shall apply to every new high speed craft which is:

(i) a passenger ship which proceeds beyond extended river limits; or

(ii) a passenger ship of 24 m or more in length which operates in river or extended river limits; or

(iii) a non-passenger ship of 500 tons gross tonnage or over which proceeds beyond extended river limits.

  1. Definitions and meanings—

“High speed craft” means a craft which is capable of a maximum speed equal to or exceeding:

V = 3.7 ∇ 0.1667

where:

V = speed at displacement ∇ (in metres/second)

∇ = displacement (in cubic metres) corresponding to the design waterline

“Length” means the length overall

“New high speed craft” means:

(i) any New Zealand ship which is a high speed craft and which is built on or after the date of commencement of this notice; or

(ii) any ship which is a high speed craft and which comes into operation as a New Zealand ship on or after the date of commencement of this notice.

Other expressions used in this notice, which are defined in the Shipping and Seamen Act 1952 shall have the meaning so defined.

  1. Consequential amendments to the Lifesaving Appliances Codes of Practice—(1) The Lifesaving Appliances (Code of Practice for Existing Ships of Classes I and II) Notice 1989 is hereby amended:

(a) by inserting, in paragraph 1 of the Schedule, after the definition of “Existing ship” the following definition:

“High speed craft” has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994;

(b) by deleting, in paragraph 2 of the Schedule, the words “or surface effect ships.” and substituting the phrase “, surface effect ships or high speed craft”.

(2) The Lifesaving Appliances (Code of Practice for New Ships of Classes I and II) Notice 1989 is hereby amended:

(a) by inserting, in paragraph 1 of the Schedule, after the definition of “Float-free launching”, the following definition:

“High speed craft” has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994;

(b) by deleting, in paragraph 2 of the Schedule, the words “or surface effect ships.” and substituting the phrase “, surface effect ships or high speed craft”.

(3) The Lifesaving Appliances (Code of Practice for Class III Ships) Notice 1989 is hereby amended:

(a) by inserting, in paragraph 1 of the Schedule, after the definition of “Class III ship”, the following definition:

“High speed craft” has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994;

(b) by deleting, in paragraph 2 of the Schedule, the words “or surface effect ships.” and substituting the phrase “, surface effect ships or high speed craft”.

(4) The Lifesaving Appliances (Code of Practice for Class IV Ships) Notice 1989 is hereby amended:

(a) by inserting, in paragraph 1 of the Schedule, after the definition of “Dinghy”, the following definition:

“High speed craft” has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994;

(b) by deleting, in paragraph 2 of the Schedule, the words “or surface effect ships.” and substituting the phrase “, surface effect ships, or high speed craft of 24 m length or over”.

(5) The Lifesaving Appliances (Code of Practice for Class V Ships) Notice 1989 is hereby amended:

(a) by inserting, in paragraph 1 of the Schedule, after the definition of “Class V ship”, the following definition:

“High speed craft” has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994;

(b) by deleting, in paragraph 2 of the Schedule, the words “or surface effect ships.” and substituting the phrase “, surface effect ships or high speed craft of 24 m length or over”.

(6) The Lifesaving Appliances (Code of Practice for Class VI Ships) Notice 1989 is hereby amended:

(a) by inserting, in paragraph 1 of the Schedule, after the definition of “Dinghy”, the following definition:

“High speed craft” has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994;

(b) by deleting, in paragraph 2 of the Schedule, the words “or surface effect ships.” and substituting the phrase “, surface effect ships or high speed craft”.

(7) The Lifesaving Appliances (Code of Practice for New Ships of Classes VII, VIIA and VIII) Notice 1989 is hereby amended:

(a) by inserting, in paragraph 1 of the Schedule, after the definition of “Free-fall launching”, the following definition:

“High speed craft” has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994;

(b) by inserting after paragraph 1 of the Schedule, the following paragraph:

“1A. Application—This Schedule applies to New Ships of Classes VII, VIIA and VIII except such ships which are high speed craft.”

(8) The Lifesaving Appliances (Code of Practice for Existing Ships of Class VII) Notice 1989 is hereby amended:

(a) by inserting, in paragraph 1 of the Schedule, after the definition of “Existing ship”, the following definition:

“High speed craft” has the meaning defined in the Ship Construction and Safety Equipment (Code of Practice for New High Speed Craft) Notice 1994;

(b) by inserting after paragraph 1 of the Schedule, the following paragraph:

“1A. Application—This Schedule applies to Existing Ships of Class VII except such ships which are high speed craft.”

(9) The Lifesaving Appliances (Code of Practice for Existing Ships of Class VIII) Notice 1989 is hereby amended:

(a) by inserting, in paragraph 1 of the Schedule, after the definition of “Existing ship”, the following definition:
