The Treaty of Waitangi Act 1975

This notice concerns 6 parcels of land in Newmarket, central Auckland and Maori claims under the Treaty of Waitangi Act 1975.

The land in Newmarket, central Auckland, which this notice concerns is described in legal terms as follows:

78D/43 304 square metres Lot 11, Deeds Plan 16.
78D/45 319 square metres Lot 1 on D.P. 34120.
79A/43 105 square metres Lot 1 on D.P. 133723.
80C/204 3.9887 hectares Lot 1, D.P. 136599.

Certificate of Title Area Lot and DP No.
83A/185 5310 square metres Lot 1 on D.P. 139738.

The land was once owned by the Crown. It has been transferred to a State Owned Enterprise under the State-Owned Enterprises Act 1986.

There is a memorial on the certificate of title of each parcel of land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Maori ownership (see sections 27A and 27B of the State-Owned Enterprises Act 1986).

The current owners of the land, New Zealand Railways Corporation, have applied to the Waitangi Tribunal to have these memorials removed. This has been done under section 8D of the Treaty of Waitangi Act 1975.

The application by New Zealand Railways Corporation states that these lands are covered by an agreement with Ngati Whatua o Orakei Maori Trust Board and the Ngati Paoa
