Second Schedule

The right to erect and install lines of poles and buried electrical cables and lights on and under that part of the land described in the said First Schedule marked “B on Land Transfer Plan 76050 (called ‘the easement area’)” for the purpose of assisting the navigation, landing and other operational activities of the Royal New Zealand Air Force and upon and subject to the following conditions:

  1. The grantee shall have the right from time to time, with such notice to the grantor as may be practicable in the circumstances, to enter upon the easement area with or without machinery, vehicles or equipment for the purpose of carrying out repairs, cables or lights and to open up the soil thereof to such an extent as may be necessary and reasonable in that regard provided that the surface is restored as nearly as possible to its original condition and any other damage done by reason of the aforesaid operations is repaired, such repair, maintenance and renewal work to be carried out with due regard to the grantor’s farming operations and as expeditiously as possible.

  2. The grantor may carry on normal pastoral farming operations on the easement area provided that it shall not plough or break up the surface thereof in the area where the said cables are laid.

  3. The grantee shall provide a crash gate to enable it to have access to the easement area and shall at its expense keep such gate repaired and maintained. Such gate is to be stockproof and is to be kept closed at all times.

Easement Over Land Acquired for Defence Purposes in Manawatu District (RNZAF, Ohakea)

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Wanganui, declares that, an agreement to that effect having been entered into, with the owner of the land in the First Schedule to this notice (called “the grantor”), the easement described in the Second Schedule is hereby acquired as an easement in gross over that part of the land described in the First Schedule as is specified in the said Second Schedule and shall vest in the Crown (called “the grantee”) for defence purposes (and may be surrendered at any time by notice in the Gazette) on the date of publication in the Gazette.

On such removal the land disturbed by the work shall be restored to a satisfactory standard of topsoil and re-grassing and the work will be carried out at a time suitable to the grantor and will accommodate its farming operations.

  4. The grantee shall at its expense construct a gate entrance to the easement area including a roadside culvert pipe.

Stopped Road in Rodney District to be Vested

Pursuant to section 117 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares the part of stopped road described in the Schedule to be vested in Adolph Farms Limited of Warkworth, subject to all encumbrances registered on certificate of title 1110/149, on the date of registration of this notice in the Land Registry Office.

433 square metres, being Section 1, S.O. Plan 64909, lodged in the office of the Chief Surveyor at Auckland.

Amending a Declaration Declaring Land Taken in Whangarei City

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, amends the declaration, dated the 20th day of October 1980, published in the New Zealand Gazette of 30 October 1980, No. 128, page 3195, declaring land to be taken in Whangarei City, pursuant to section 32 of the Public Works Act 1928 by inserting after the words “is hereby taken,” the words “subject to the right of way easement contained in Gazette notice 19832”.
