Pursuant to sections 117 and 120 (3) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager (Lands and Property), Department of Survey and Land Information, Christchurch, declares the stopped road described in the Schedule hereto, now known as Rural Sections 41795, 41797 and 41798, to be vested in Alan Bruce Totty of Staveley, farmer and Jane Lea Totty, his wife (and shall be amalgamated with the land in certificate of title No. 25K/941, Canterbury Land District, subject to covenant 420526/1 and memorandum of mortgage 970674/4).

(a) Pursuant to section 114 (1), the land firstly described in the Schedule to be road which pursuant to section 60 (2) of the Transit New Zealand Act 1989 shall form part of State Highway No. 2.

(b) Declares the land secondly described in the Schedule to be taken for the purposes of section 119 (1).

Amending Notice Acquiring Land for Addition to Farndon Park at Clive

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, hereby amends the notice dated 2nd March 1993 published in New Zealand Gazette of 11th March 1993, page 659 (IN. 1824) under the heading “Land Acquired for Addition to Farndon Park at Clive”, by deleting the declaration above the Schedule and replacing the same with the following:

“Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares that, an agreement to that effect having been entered into the land described in the Schedule is acquired (subject to an easement in gross for soil conservation and river control purposes in favour of the Hawke’s Bay Regional Council created by a Gazette notice dated 2nd March 1993, published in the New Zealand Gazette dated 11th March 1993 at page 659) for the purposes of the Reserves Act 1977, as a recreation reserve and as an addition to the Farndon Park Domain administered by the Hastings District Council which shall vest in the Crown on the date of publication in the Gazette.”
