that, an agreement to that effect having been entered into, the following easements in gross are acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the Gazette) vesting in The Hawke’s Bay Regional Council (called “the grantee”) on the date of publication in the Gazette:

A right to operate and maintain river control works including a stopbank in terms of the Soil Conservation and Rivers Control Act 1941, over the land described in the Schedule and for such purposes:

(a) To enter the land and to pass and repass at all times with or without machinery or vehicles;

(b) To prohibit overgrazing of the land and destruction of vegetation by fire or cultivation;

(c) To prohibit the planting of trees or crops (other planting may be undertaken with the approval of the grantee; such approval shall not be unreasonably withheld) on the land;

(d) To prohibit the erection of any building on the land; and

(e) To exercise the within rights in a manner reasonably necessary to serve the purpose of the work.
