Notice of Intention to Take Land for Soil Conservation and River Control in Lower Hutt City

Take notice that The Wellington Regional Council, duly constituted under the provisions of the Local Government Act 1974, and being a local authority within the meaning of the Public Works Act 1981, proposes to take under the Public Works Act 1981, the freehold interest of Maud, Kirk Machinery Limited at Wellington in the land described in the Schedule to this notice.

The land is required for soil conservation and river control and it is intended to use the land for the purposes of such public work.

And notice is hereby given that all persons who are affected by the execution of the said public work or by taking of the said land should state their objections in writing and send the same to the Registrar, Planning Tribunal, Tribunals Division, Justice Department, Private Bag, Postal Centre, Wellington, within 10 working days after the second publication of this notice.

If you make an objection, a public hearing of the objection will be held unless you give written notice to the Tribunal that you want the hearing to be held in private.

If you make an objection:

(a) You will be advised of the time and place of the hearing; and

(b) You will have the right to appear and be heard personally or be represented by a barrister and solicitor or any other person you authorise.

This notice, and the right to object described above, relate to the taking of the interest in the land and not the right to compensation. If this compensation cannot be agreed upon, it can be determined in separate proceedings before the Land Valuation Tribunal.
