Declaring Subsoil of the Rimutaka Railway Tunnel to be Set Apart for Railway Purposes

Pursuant to sections 24 and 30 of the New Zealand Railways Corporation Act 1981 and section 20 of the Public Works Act 1981, the Chief Executive of the New Zealand Railways Corporation hereby declares all that subsoil of the land, below a plane 162 metres above mean sea level, described in the First Schedule hereto, and all that subsoil of the land, below a plane 140 metres above mean sea level, described in the Second Schedule hereto, to be set apart for and on behalf of Her Majesty the Queen for railway purposes.

First Schedule

Wellington Land District—South Wairarapa District

2,1500 hectares, being part Rimutaka State Forest Park situated in Block IV, Rimutaka Survey District and Blocks I and II, Wairarapa Survey District; marked “E” on plan L.O. 36712 (S.O. 37101), lodged in the office of the New Zealand Railways Corporation at Wellington.

Second Schedule

Wellington Land District—South Wairarapa District

1,4440 hectares, being part Suburban Section 351, Featherston Suburban, situated in Block II, Wairarapa Survey District; marked “F” on plan L.O. 36712 (S.O. 37101), lodged in the office of the New Zealand Railways Corporation at Wellington.

Road Stopped in Thames-Coromandel District

Pursuant to sections 116 and 117 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton, declares the pieces of road described in the Schedule hereto to be closed and that:

(a) Areas “C” and “D”, now known as Sections 1 and 3, S.O. 59631 respectively, shall be amalgamated with the land in certificate of title No. 46C/734, South Auckland Land Registry.

(b) Area “E”, now known as Section 2, S.O. 59631, shall be amalgamated with the land in certificate of title No. 51C/894, subject to memorandum of mortgage B. 134795.2, South Auckland Land Registry.

(c) Area “I”, now known as Section 1, S.O. 59625, shall be amalgamated with the land in certificate of title No. 29B/873, South Auckland Land Registry.
