4. Approval as requiring authority in respect of other projects or works—Telecom Mobile Communications Limited is hereby approved as a requiring authority under section 167 of the Resource Management Act 1991 in respect of the following projects or works:

(a) Any line or lines, radio apparatus, and works of its network in respect of sites of which Telecom Corporation of New Zealand Limited (or any of its subsidiary companies as defined in the Companies Act 1955) or Telecom Mobile Communications Limited is an owner or the holder of any other estate or interest;

(b) The operation, erection, installation, maintenance, replacement, alteration, and improvement of any such line or lines, radio apparatus, or works.

The Resource Management (Approval of Telecom Mobile Communications Limited as Requiring Authority) Notice (No. 2) 1993

Pursuant to section 167 of the Resource Management Act 1991, the Minister for the Environment hereby gives the following notice.

Notice

1. Title and commencement—(1) This notice may be cited as the Resource Management (Approval of Telecom Mobile Communications Limited) Notice (No. 2) 1993.

(2) This notice shall come into force on the 28th day after the date of its publication in the New Zealand Gazette.

2. Interpretation—(1) In this notice, unless the context otherwise requires:

(a) Except as provided in clauses 3 (a) and 3 (b) of this notice, “line” has the meaning given to that term by section 2 (1) of the Telecommunications Act 1987; and “lines” has a corresponding meaning;

(b) “Radio apparatus”, “radiocommunication”, “road” and “telecommunication” have the meaning given to those terms by section 2 (1) of the Telecommunications Act 1987;

(c) “Network” means the system of lines, radio apparatus, and works which Telecom Mobile Communications Limited now operates, or may in the future operate, for the purpose of effecting telecommunication or radiocommunication; and includes Telecom Mobile Communications Limited’s network within the meaning of section 2 (1) of the Telecommunications Act 1987;

(d) “Works” has the meaning given to that term by section 2 (1) of the Telecommunications Act 1987.

(2) In this notice, any reference to an enactment shall be deemed to include a reference to all subsequent enactments passed in amendment or substitution for that enactment.

3. Approval as requiring authority in respect of network utility operation—Telecom Mobile Communications Limited is hereby approved as a requiring authority under section 167 of the Resource Management Act 1991 in respect of the particular network utility operation described as follows:

(a) Any line or lines within the meaning of section 2 (1A) of the Telecommunications Act 1987, radio apparatus, and works of its network in respect of any road and the operation, erection, installation, maintenance, replacement, alteration, and improvement of any such line or lines, radio apparatus, or works;

(b) Any line or lines within the meaning of section 2 (1A) of the Telecommunications Act 1987, radio apparatus, and works of its network in respect of any land to which section 11 or section 12 of the Telecommunications Act 1987 applies and the operation, erection, installation, maintenance, replacement, alteration, and improvement of any such line or lines, radio apparatus, or works;

(c) Any line or lines, radio apparatus, and works of its network in respect of any other site in New Zealand of which Telecom Corporation of New Zealand Limited (or any of its subsidiary companies as defined by the Companies Act 1955) or Telecom Mobile Communications Limited may, at any time, become an owner or the holder of any other estate or interest and the operation, erection, installation, maintenance, replacement, alteration, and improvement of any such line or lines, radio apparatus, or works.

The Resource Management (Approval of Rotorua Regional Airport Limited as Requiring Authority) Notice 1993

Pursuant to section 167 of the Resource Management Act 1991, the Minister for the Environment, hereby gives the following notice:

Notice

1. Title and commencement—(1) This notice may be cited as the Resource Management (Approval of Rotorua Regional Airport Limited as Requiring Authority) Notice 1993.

(2) This notice shall come into force on the 28th day after the date of its publication in the New Zealand Gazette.

2. Interpretation—In this notice, unless the context otherwise requires, the word “airport” means any defined area of land or water intended or designed to be used either wholly or partly for the landing, departure, movement, or servicing of aircraft; and includes any buildings, installations, and equipment on or adjacent to any such area used in connection with the airport.

3. Approval as requiring authority—Rotorua Regional Airport Limited is hereby approved as a requiring authority for the operation of the Rotorua Airport situated at Rotokawa between the shores of Lake Rotorua and State Highway 30 in the Rotorua District.
