Notice of Approval of Guardian Trust Australia Limited to Act as a Trustee

The Securities Commission acting under the authority of section 48 of the Securities Act 1978 hereby approves Guardian Trust Australia Limited to act as a trustee in respect of unsecured mandatory convertible notes (“the securities”) to be offered to the public by Challenge Properties Limited subject to the condition that The New Zealand Guardian Trust Company Limited acts as a trustee in respect of the securities at all times during the life of the securities.

Pursuant to section 4 (1) (a) (i) of the Harbour Boards Dry Land Endowment Revesting Act 1991, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares the land described in the Schedule, being part of the land referred to in Part A of the Schedule to the said Act as the “Napier Harbour lands”, to be revested in the Crown and held for conservation purposes.

All those pieces of land situated in Block IV, Heretaunga Survey District, described as follows:

As shown on the above S.O. plans lodged in the office of the Chief Surveyor at Napier.

Reserves Act 1977

Revocation of the Reservation Over a Reserve Specifying the Manner of Disposal and How Proceeds of Sale Shall be Utilised

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator, Auckland Conservancy, Department of Conservation, hereby revokes the reservation as recreation reserve over the land, described in the Schedule hereto, and further declares that the said land may be disposed of by The Papakura District Council at current market value, the proceeds from any such sale to be paid into the council’s reserves account, such moneys to be used and applied in or towards the improvement of other reserves under the control of the council, or in or towards the purchase of other land for reserves.

574 square metres, more or less, being Lot 5, D.P. 41914. Balance certificate of title 596/29.

1012 square metres, more or less, being Lot 5, D.P. 40722. Part certificate of title 596/18.

Both situated in Block XV, Otahuhu Survey District.
