Land Acquired Subject to a Right to Convey Water Easement for Soil Conservation and River Control Purposes in Hauraki District Subject to a Right of Way Easement

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Hamilton, declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired, subject to a right to convey water easement created by transfer H. 706453.1, for soil conservation and river control purposes and shall vest in The Waikato Regional Council on the date of publication hereof in the New Zealand Gazette, subject to the right of way easement described in the Second Schedule hereto, to be held over the land secondly described in the First Schedule hereto, to be held appurtenant to the land described in the Third Schedule hereto.

Second Schedule

South Auckland Land District

Description of Easement

The rights and powers implied by and attaching to a right of way as set out in the Seventh Schedule of the Land Transfer Act 1952, and the Ninth Schedule Property Law Act 1952, as if the same were fully set out herein, but excluding the rights implied in easements of vehicular right of way set out in clause 2 (c) in the Ninth Schedule of the Property Law Act 1952.

Third Schedule

South Auckland Land District

6.4343 hectares, being part Lot 5, D.P. S. 334133, being balance of the land contained in certificate of title No. 45A/40.

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Hamilton, declares that, agreements to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired in connection with a road, and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.

Pursuant to section 20 of the Public Works Act 1981 and section 88 (2) of the Transit New Zealand Act 1989, and to a delegation from the Minister of Lands, the District Solicitor of the Department of Survey and Land Information, Hamilton, declares that, an agreements to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired for limited access road and has become road, limited access road and State highway and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.
