21 OCTOBER NEW ZEALAND GAZETTE

Right of Way Easement and Right to Extract Roading Material at Mount Tarapouni in Hawke’s Bay

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares that an agreement has been entered into, the following easements are acquired over the land described in the First Schedule to be forever appurtenant to the land described in the Second Schedule for the purposes of access to the land described in the Second Schedule. The easements shall vest in the Crown on the date of publication in the New Zealand Gazette. Such easement may be surrendered at any time by notice published in the New Zealand Gazette.

Easements

  1. Right of Way: A right of way over those parts of the land described in the First Schedule marked “B”, “C” and “E” on S.O. 10193 (“E” also being Section 24, S.O. 8760), “J” on S.O. 10198 (also marked “E” on S.O. 9375), upon the terms and conditions as set out in the Seventh Schedule of the Land Transfer Act 1952 and the Ninth Schedule of the Property Law Act 1952.

  2. Right to Extract Roading Material: The right for the grantee, her servants, agents, workmen and any other person lawfully entitled to enter onto that part of the land described in the First Schedule marked “D” on S.O. 10193 and to excavate and extract rocks, road metal and other roading material for use in the construction and maintenance of the right of way with or without vehicles and earth-moving machinery.

Additional Rights Included in the Easements

The right for the grantee, her servants, agents, workmen and other persons lawfully entitled so to do together with any tools, implements, machinery, vehicles or equipment of whatsoever nature necessary for the purpose to enter upon those parts of the land over which the easements are granted and remain there for any reasonable time for the purpose of constructing, inspecting, repairing and maintaining the right of way and earth-moving machinery.

S.O. 10193 and 10198 are held in the office of the Chief Surveyor at Napier.

Interest in Conservation Land Set Apart for Access to Land Held for Buildings of the General Government in Hawke’s Bay (Access to Mount Tarapouni Repeater Station)

Pursuant to section 52 (1) of the Public Works Act 1981, and pursuant to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares that a right of way easement over the land described in the First Schedule is hereby set apart to be forever appurtenant to the land described in the Second Schedule for the purposes of access to the land described in the Second Schedule. There shall be implied in the easement the rights and powers set out in the Seventh Schedule of the Land Transfer Act 1952. Such easement may be surrendered at any time by notice published in the New Zealand Gazette.

Pursuant to section 52 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Hamilton, declares the land described in the Schedule hereby, to be set apart for the development of water power (Lake Taupo and the Waikato River Power Scheme).

1347 square metres, situated in Block II, Whakamaru Survey District, being part river bed (Crown land); as shown marked “B” on S.O. Plan 59599, lodged in the office of the Chief Surveyor at Hamilton.
