possible to its original condition and any other damage down by reason of the aforesaid operations is repaired.

(3) The grantors shall not at any time on or over the easement area marked “A” on S.O. Plan 66732 without the prior consent of the grantee:

(a) place any buildings, erections or fence or permanent improvements of any nature;

(b) do permit or suffer an act whereby the rights, powers, licences and liberties hereby granted to the grantee may be interfered with or affected; or

(c) do permit or suffer any act whereby the access easement may be interfered with or damaged.

Provided however that where the terms of these presents require the consent of the grantee to be obtained in respect of any matter herein referred to then the grantee shall not unreasonably or arbitrarily withhold such consent.

(4) The grantee shall:

(a) construct and form walkway access over the easement land for the purposes of pedestrian access to and from the dominant land;

(b) at all times repair and maintain such access as may be constructed on the easement land in pursuance of these present in a good and efficient state of repair for the purposes for which the same is designed or where the need for such maintenance or repair is directly attributable to the use of the access by the grantee, its staff, agents or invitees, provided however should the grantors be responsible for causing damage to the access by reason of abnormal or negligent use of the access or use of heavy machinery then the grantors shall be solely responsible for the cost of repairing such damage.

(5) The grantors shall at their own expense obtain such consents to the within grant of access easement as may be required and shall construct and maintain a pedestrian bridge over the stream bordering the dominant and servient lands.

State-Owned Enterprises Act 1986

Land Vested in Landcorp Property Limited

Pursuant to section 24 (1) of the State-Owned Enterprises Act 1986, and to an authorisation dated 15 May 1992 from the Ministers of Finance and State-Owned Enterprises, the Director (Statutory), Department of Survey and Land Information, hereby gives notice as follows:

Notice

  1. Title—This notice may be cited as the Landcorp Property Limited Vesting Notice 1993, No. 3.

  2. Application—(1) This notice applies to all the land described in the Schedule to this notice, saving and excepting:

(a) The bed of any lake whose bed has an area of 8 hectares or more;

(b) The bed of any river whose bed has an average width of 3 metres or more;

(c) Any land covered and uncovered by the flow and ebb of the tide at mean spring tides.

(2) In subclause (1) of this clause, the terms “bed”, “lake”, and “river” have the meanings assigned to them by section 2 (1) of the Resource Management Act 1991.

  1. Vesting—Subject to section 24 of the Conservation Act 1987, the land to which this notice applies:

On the date of publication of this notice in the New Zealand Gazette shall vest for an estate in fee simple in Landcorp Property Limited (a company duly incorporated under the Companies Act 1955, having its registered office at Wellington, and being a State enterprise within the meaning of section 29 (1) of the State-Owned Enterprises Act 1986):

(i) Together with the appurtenant rights (if any) described in the Schedule to this notice; but

(ii) Subject to the rights, interests and encumbrances (if any), to which it is described in the Schedule to this notice as being subject.
