Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Christchurch, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for a limited access road which becomes road, limited access road and State highway and shall vest in the Crown on the date of publication of this declaration in the New Zealand Gazette.

Temporary Easement for Sewage Treatment and Disposal Purposes Acquired at Opotiki

Pursuant to sections 20 and 50 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, Gisborne, declares on an agreement to that effect having been entered into by the Minister of Conservation (“the grantor”) and The Opotiki District Council (“the grantee”) declares that the easement described in the First Schedule is acquired as an easement in Gross for sewage treatment and disposal purposes for a period of 6 months from the 1st day of August 1993, and shall determine the expiry of such period without the necessity of a formal surrender or any other action on the part of either the grantor or the grantee.

First Schedule

Temporary Easement for Sewage Treatment and Disposal Purposes

The right to treat and dispose of sewage by way of temporary oxidation ponds and pipes laid and constructed on the land described in the Second Schedule and for such purposes—To:

(a) Enter the land pass and repass at all times with or without machinery and vehicles.

(b) Form an access track to suit a truck with a five cubic metre water tank.

(c) Excavate for and form a bank for a 20–25 cubic metre pond lined with clay or silt carted to the site or otherwise a synthetic material.

(d) Construct a low level bunded area for two minor cells each approximately 30 metres square.

(e) Establish a portable generator and pump site and lay temporary sewer pipes over the surface of the land.

(f) Install 10 piezometer pipes for water sample stations for water table monitoring purposes incidental to the treatment and disposal of sewage.

Terms and Conditions of Easement:

(1) All necessary earthworks, pipes, equipment and other works necessary for the operation of the easement shall be installed and erected out only on those parts of the land specified by the grantor before any earthworks, pipes,
