Far North District Council

Public Works Act 1981

Notice of Intention to Take Land at Shepherds Road, Fern Flat, for Road

Notice is hereby given that The Far North District Council, under the provisions of the Public Works Act 1981, intends to take the land described in the Schedule hereto for road, to legalise the existing formed alignment of Shepherds Road.

The taking is considered reasonably necessary as the road cannot be relocated to its legal alignment due to the topography of the land and the proximity of the Toro Stream. The road is required to provide access to properties on this road.

Any person having an estate or interest in the land may, within 20 working days after the date of this notice, send an objection to the Registrar, Planning Tribunal, Tribunals Division, Justice Department, P.O. Box 5027, Wellington. If any objection is made in accordance with this notice, a public hearing will be held, unless the objector otherwise requires, and each objector will be informed of the date, time and place of the hearing.

Schedule

North Auckland Land District

All that piece of land containing 7079 square metres, situated in Block VI, Maungataniwha Survey District, being part Allotment N28, shown as area “A” on Survey Office Plan No. 59022, lodged in the office of the Chief Surveyor at Auckland.

A copy of the plan may be inspected at the Kaitaia Service Centre of The Far North District Council, Redan Road, Kaitaia, during normal office hours.

The land to be taken is formed as road, and is situated approximately 900 metres south of the Shepherds Road/Fern Flat Road junction.

Dated at Kaikohe this 10th day of August 1993.
