Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares that an agreement to that effect having been acquired for road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 5. The land in the Schedule shall vest in the Crown on the date of publication in the New Zealand Gazette.

Crown Land Set Apart and Land Taken for Limited Access Road, Stream Diversion in Connection with a Road or for Addition to the Katere Scenic Reserve, Devon Road, New Plymouth

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, New Plymouth:

(a) Pursuant to section 52 of the aforesaid Act and section 88 (2) of the Transit New Zealand Act 1989, declares the land described in the First Schedule hereto, to be set apart for a limited access road, which has become road, limited access road and State highway.

(b) Pursuant to sections 20 or 52, the land in the Second Schedule is taken or set apart for a stream diversion required in connection with a road.

(c) Pursuant to section 52, the land in the Third Schedule hereto, to be set apart for addition to the Katere Scenic Reserve, subject to the Reserves Act 1977.

All land to vest or to remain vested in the Crown on the date of publication of this declaration in the New Zealand Gazette.
