Land and Interests over Land Acquired for Regional Road in Auckland City

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares that an agreement to that effect having been entered into:

(i) The land described in the First Schedule hereto, is acquired for regional road; and

(ii) The airspace from and above the undersurface of the overpass structure constructed 5 metres, more or less, above the surface of the land described in the Second Schedule is acquired for regional road; and

(iii) The land and airspace from and below a horizontal plane 5 metres above the surface of the land described in the said Second Schedule hereto is acquired, reserving however for New Zealand Express Transport Limited, a duly incorporated company having its registered office at Auckland, and its successors and assigns, a right of way easement, which shall be forever appurtenant to the land described in the Fourth Schedule hereto, containing the rights and powers set forth in clause 1 of the Seventh Schedule to the Land Transfer Act 1952, as modified by the terms and conditions set out in the Third Schedule hereto, in connection with a regional road,

and the said land and airspace shall vest in The Auckland Regional Council from the date of publication of this notice in the Gazette.

Third Schedule

North Auckland Land District

  1. New Zealand Express Transport Limited (hereinafter called “the company”), the registered proprietor of the land described in the Fourth Schedule and its invitees shall not be entitled to exercise the rights created herein to use the said right of way until such time as Church Street is terminated at the eastern side of the North Auckland Main Trunk Railway.

  2. The right of way easement shall be limited as to height with a minimum clearance from the carriageway surface to the underside of the overpass structure of 5 metres.

  3. The Auckland Regional Council shall construct the right of way to a standard suitable for heavy vehicles, such construction to be completed prior to the said termination of Church Street.

  4. Until the construction of the said regional road, the company shall be solely responsible for the maintenance and repair of the said right of way.

  5. Upon completion of the construction of the right of way, the company or its successors in title and the then registered proprietor of Lot 1, D.P. 52065 (certificate of title 88C/523) shall bear equal responsibility for the repairs and maintenance provided however should either of the said parties be responsible for causing damage to the said right of way, then that party shall be solely responsible for the cost of repairing such damage.

Fourth Schedule

North Auckland Land District

8078 square metres, being Lot 5, D.P. 58753, being part Allotment 3, Section 17, Suburbs of Auckland. All certificate of title 13B/674.

Dated at Auckland this 22nd day of January 1993.

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares that an agreement to that effect having been entered into, the land described in the Schedule is acquired in connection with the Auckland-Waiwera Motorway and shall vest in the Crown on the date of publication in the Gazette.
