New Zealand Railways Corporation Act 1981

Declaring Land at Kakapuaka to be Set Apart for Railway Purposes

Pursuant to sections 24 and 30 of the New Zealand Railways Corporation Act 1981 and section 52 of the Public Works Act 1981, the Chief Executive of the New Zealand Railways Corporation, hereby declares the land described in the Schedule hereto, to be set apart for and on behalf of Her Majesty the Queen for railway purposes.

All that piece of land containing 7953 square metres, being part closed road and part Section 2, Block XXXIII, Clutha Survey District; and being part of the land comprised and described in conveyance 52271 (deeds index Q. 952); as shown marked “C” on plan L.O 29417 (S.O. 18304), lodged in the office of the New Zealand Railways Corporation at Wellington.

Notice of Intention to Take Land for Buildings of the General Government in Wellington City

Take notice that the Minister of Lands proposes to take under the Public Works Act 1981, the interest of Frederick William Mead Dowsett, in the land described in the Schedule to this notice.

The land is required for buildings of the General Government and it is intended to use the land for the purposes of such public work.

And notice is hereby given, that the land so required to be taken is shown on a plan lodged in the offices of the Chief Surveyor, Department of Survey and Land Information, Wellington, and there numbered Survey Office Plan No. 36713.

Your interest in the land has not yet been taken.

Frederick William Mead Dowsett or his successor or any other person who has an estate or interest in the land has a right to object to the taking of that interest in the land.

If you wish to object you must send a written objection to the Registrar, Planning Tribunal, Tribunals Division, Justice Department, Private Bag, Postal Centre, Wellington, within 10 working days after the second publication of this notice.

If you make an objection, a public hearing of the objection will be held unless you give written notice to the Tribunal that you want the hearing to be held in private.

If you make an objection,—

(a) You will be advised of the time and place of the hearing; and

(b) You will have the right to appear and be heard personally or be represented by a barrister and solicitor or any other person you authorise.

This notice, and the right to object described above, relate to the taking of your interest in the land and not your right to compensation. Under the Public Works Act 1981, you are entitled to full compensation, if your interest in the land is taken. If this compensation cannot be agreed between you and the Minister of Lands, it can be determined in separate proceedings before the Land Valuation Tribunal.

This notice concerns your rights over the land referred to. If you are in any doubt about its effect you should obtain legal advice immediately.
