Amending a Notice Declaring Land to be Road, Road to be Stopped and Vested and Land to be Severance and Vested in Block I, Owhanga Survey District

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Wellington, hereby amends the notice dated the 28th day of January 1992 and published in the New Zealand Gazette of the 7th day of February 1992 at page 298 by:

amending paragraph (ii) of the recital to read:
‘the road firstly, thirdly, fourthly and eighthly described in the Second Schedule hereto to be stopped and amalgamated with CT 192/271, subject to mortgage B. 080205.4 and profit à prendre 923783.1’

amending paragraph (v) of the recital to read:
‘the road seventhly described in the Second Schedule hereto to be stopped and amalgamated with CT 223/151, subject to mortgage B. 080205.4 and profit à prendre 923783.1’

and deleting all of the Third Schedule of the notice.

Land Acquired for Motorway Purposes, Land Acquired for Railway Purposes, Land Taken for State Highway and Land to be Vested in The Wellington Regional Council in Block XII, Belmont Survey District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Wellington:

(a) Pursuant to section 52, declares that the land held for railway described in the First Schedule hereto, to be set apart for motorway purposes.

(b) Pursuant to section 52 of the Public Works Act 1981 and section 60 of the Transit New Zealand Act 1989 declares:

(i) The land held for railway described in the Second Schedule hereto to be set apart for State highway.

(ii) The land described in the Third Schedule hereto to be set apart for State highway.

(c) Pursuant to sections 20 and 50, declares that, an agreement to the effect having been entered into, the land described:

(i) In the Fourth Schedule hereto, is hereby acquired for motorway and shall vest in the Crown on the date of publication hereof in the Gazette.

(ii) In the Fifth Schedule hereto, is hereby acquired for Railway purposes and shall vest in the Crown.

(iii) In the Eighth Schedule hereto, to be set apart for State Highway.

(d) Pursuant to section 114, declares the land described in the Sixth Schedule hereto, to be taken for use, enjoyment and convenience of a road.

(e) Pursuant to section 119 (1), declares the land described in the Seventh Schedule hereto, to be severance and vested in the Wellington Regional Council.
