Declaring an Easement over Land in the Whangarei District

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares that, an agreement to that effect having been entered into, a stormwater drainage easement in gross vesting in Her Majesty the Queen and her heirs, successors and assigns the rights and powers set forth in the third and fifth paragraphs of the Seventh Schedule of the Land Transfer Act 1952, as modified by the provisions contained in the Second Schedule over the land described in the First Schedule, is hereby acquired in connection with a limited access road (State Highway No. 1) and shall vest in the Crown on the date of publication of this notice in the Gazette.

First Schedule

North Auckland Land District

All that parcel of land being part Lot 32, D.P. 22714 and part Section 1, S.O. Plan 60349; shown marked “C” on S.O. Plan 60349, lodged in the office of the Chief Surveyor at Auckland.

Second Schedule

North Auckland Land District—(Modification to Easement)

1. The Whangarei District Council as an invitee of the Crown may together with its workmen, officers, contractors and any other person so lawfully entitled to do so, avail itself of the rights and powers herein acquired, whether or not on behalf of the Crown, but subject to the conditions herein.

2. The Crown will maintain and keep in good repair the said easement to a standard sufficient to enable Donald Lawrence Billington of Hukarangi, retired and Loran Fay Billington, his wife, the registered proprietors of the land described in the First Schedule (together with their heirs, successors and assigns called “The Owner”) to satisfactorily carry out normal farming business. Provided that the need for such maintenance and repair is not attributable to the neglect or default of the Owner his servants or invitees.

3. The Owner will give the Crown notice in writing of any defect or want of repair to the said easement and the Crown shall not be liable for any deterioration or damage unless in receipt of such notice.
