Social Security Act 1964

Direction to Director-General of Social Welfare

In the matter of section 5 (2) of the Social Security Act 1964.

To: The Director-General of Social Welfare.

I, Jennifer Mary Shipley, Minister of Social Welfare, hereby give you the following direction, pursuant to section 5 (2) of the Social Security Act 1964 (“the Act”):

  1. This direction applies to any person applying for the 55 plus benefit under section 58 of the Act who—

    (a) Was aged 55 years or more on 1 April 1992; and

    (b) Was employed on 1 April 1992 under an employment contract (within the meaning of the Employment Contracts Act 1991) in writing which specified an age at which that person was required to retire; and

    (c) Pursuant to the section 15C of the Human Rights Commission Act 1977, agreed with his or her employer in writing on or after 1 April 1992 to confirm or vary the age specified in the employment contract.

  2. Where a person to whom this direction applies retired, or was required to retire, on or about the age confirmed or varied by the agreement with the employer, and that age is less than the age at which the person becomes entitled to national superannuation under section 3 of the Social Welfare (Transitional Provisions) Act 1990, you shall not consider the person to be voluntarily unemployed without a good and sufficient reason if the agreement with the employer to confirm or vary the age was reached for good reason.

  3. For the purposes of this direction, you shall accept as good reason for confirming a retiring age, or for varying a retiring age to a date after the age specified in the employment contract, that the employment relationship and the retiring age, in respect of the person, had been in effect for not less than 5 years, and both parties considered that their existing retirement arrangements should continue to apply.

  4. You shall not accept an agreement to vary a retiring age to an age earlier than that specified in the employment contract as having been reached for good reason unless for good reason based upon the person’s health or fitness to continue performing the work for which he or she was employed under the employment contract.
