Dumping and Countervailing Duties Act 1988

Initiation of Dumping Investigation: Certain Non-Leather Women’s Footwear from China

Notice is hereby given that I, Alexander Hugh McPhail, Manager, Trade Remedies Group, Ministry of Commerce, acting pursuant to section 10(1) of the Dumping and Countervailing Duties Act 1988, and under delegated authority from the Secretary of Commerce, have initiated an investigation to determine both the existence and effect of alleged dumping of the goods listed in the Schedule to this notice, being satisfied that sufficient evidence has been provided that:

(a) The goods imported or intended to be imported into New Zealand are being dumped; and

(b) By reason thereof material injury to an industry has been or is being caused, or is threatened.

Country of Origin:

People’s Republic of China.

Description of Goods Subject to Investigation:

Women’s footwear with outer soles and uppers of “rubber or plastic” but excluding:

Women’s and girls shoes size 4 and below;

Waterproof footwear;

Sports footwear;

Footwear with upper straps or thongs assembled to the sole by means of plugs;

Footwear covering the ankle;

Footwear incorporating a protective metal toe cap;

Footwear with outer soles and uppers moulded in one piece from PVC or another plastic material or from rubber;

Slippers.

The expression “rubber or plastic” includes any textile material visibly coated or covered externally with one or both of those materials.

The goods are currently classified under Tariff Item and Statistical Key 6402.99.19.09F of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

Electricity Act 1968

Standards for Medical Electrical Safety

This is to advise persons having an interest in electrical safety requirements for medical electrical equipment that the office of the Chief Electrical Inspector of the Ministry of Commerce is intending to adopt joint Australian/New Zealand Standards to set the safety requirements, pursuant to the Electricity Act 1968.

These standards are currently being drafted in Australia based on the International Electrotechnical Commission Standards for various types of medical electrical equipment by committees incorporating New Zealand representation.

Persons having an interest in the adoption of these standards are requested to register their interest with the Chief Electrical Inspectors Office.

The Chief Electrical Inspectors Office will be co-ordinating with the Standards Association of New Zealand and Standards Australia to ensure that where possible the draft standard will be available for consideration prior to promulgation to allow the introduction of variations to the International Documents.

Where variations cannot be incorporated into the text to produce joint standards, it is proposed that the variations will become part of the New Zealand Code of Practice for Electrical Safety of Apparatus and Material 1991 (NZEC P: 3 1991).

The Chief Electrical Inspectors Office will endeavour to ensure that parties which have registered their interest are kept informed of progress during this work.

The formal opportunity to comment on the introduction of these standards will be available through the public comment process associated with proposed amendments to The New Zealand Code of Practice for Electrical Safety of Apparatus and Materials 1991 (NZEC P: 3 1991).

Persons are further advised that both Standards Association of New Zealand and the Chief Electrical Inspectors Office have a common advisory committee on this topic. Information regarding membership of this committee for the drafting of those standards, which represents the interests of industry groups, is available from Standards Association of New Zealand or the Chief Electrical Inspectors Office.
