Dumping and Countervailing Duties Act 1988

Preliminary Determination: Dumping Investigation in Respect of Lead Acid Batteries from the Philippines

Pursuant to section 12 (1) of the Dumping and Countervailing Duties Act 1988 (hereinafter referred to as “the Act”), I, Philip Burdon, Minister of Commerce, hereby give notice that I have made a preliminary determination on the basis of the information made available during the investigation that there is reasonable cause to believe that lead acid automotive batteries for the passenger motor vehicle battery replacement market and marine applications (excluding DIN batteries and deep cycle marine batteries), originating in the Philippines and imported or intended to be imported into New Zealand, are goods in respect of which I may direct the imposition of an anti-dumping duty in accordance with section 14 of the Act.

Pursuant to section 12 (3) of the Act, I hereby impose a provisional measure in accordance with section 16 (1) of the Act, namely, that payment, in respect of the goods described above, of an anti-dumping duty at the rate shown in the Schedule to this notice, shall be secured by the Collector of Customs in accordance with Part IX of the Customs Act 1966 on those goods entered for home consumption on or after the 2nd day of April 1992.

Schedule

Goods:

Lead acid automotive batteries for the passenger motor vehicle battery replacement market and marine applications (excluding DIN batteries and deep cycle marine batteries) originating in the Philippines. The goods are currently classified under Tariff Item and Statistical Key 8507.10.09 00E of the Tariff of New Zealand. The Tariff Item and Statistical Key are provided for convenience and Customs purposes, the written description being dispositive.

Rates:

14% of the value for duty.

Notice of Reassessment of Anti-Dumping Duty on Hog Bristle Paintbrushes from China

Pursuant to sections 14 (3A) and 19 (4) of the Dumping and Countervailing Duties Act 1988 (as inserted respectively by sections 10 and 15 of the Dumping and Countervailing Duties Amendment Act 1990), and on the basis of new information obtained relating to the appropriate level of duty and on the structure and operations of the exporter, the Minister of Commerce gives the following notice:

Notice

1. Title—(1) This notice may be cited as the Final Dumping Determination (Paintbrushes), Amendment No. 1, and shall be read with and be part of the notice given for the Minister of Customs entitled “Final Dumping Determination”, dated 31 May 1988, published in the Gazette of 2 June 1988 (in this notice referred to as “the principal notice”) and relating to hog bristle paintbrushes.

(2) This notice shall come into force on the day after the date on which it is published in the Gazette.

2. Description of goods amended—The first paragraph of the principal notice is hereby amended by omitting the words “being found against the China National Native Produce and Animaly By-product Import Export Corporation of The Peoples Republic of China in respect of hog bristle paint brushes for household or industrial use being classified within tariff item 9603.40.00.01F of the Customs Tariff of New Zealand”, and inserting the words “in respect of the goods listed in the Schedule to this notice.”.

3. Anti-dumping duty amended—The principal notice is hereby amended by inserting, after the second paragraph, the following paragraphs:

“The normal value per dozen of the goods, for the purposes of this notice, in respect of the listed sizes by group*, shall be as follows:
