(c) Any land covered and uncovered by the flow and ebb of the tide at mean spring tides.

(2) In subclause (1) of this clause, the terms "bed", "lake" and "river" have the meanings assigned to them by section 2 (1) of the Resource Management Act 1992.

3. Approval and vesting

Subject to section 24 of the Conservation Act 1987, the land to which this order applies—

(a) Is hereby approved for the purposes of section 24 (1) (b) of the State-Owned Enterprises Act 1986; and

(b) On the 26th day of March 1992 shall vest for an estate in fee simple in Landcorp Management Services Limited (a company duly incorporated under the Companies Act 1955, having its registered office at Wellington, and being a State enterprise within the meaning of section 29 (1) of the State-Owned Enterprises Act 1986),—

(i) Together with the appurtenant rights (if any) described in the Schedule to this order; but

(ii) Subject to the rights, interests and encumbrances (if any), to which it is described in the Schedule to this order as being subject.

4. Consequential amendments

(1) The Schedule to the State-Owned Enterprises (Landcorp Management Services Limited Vesting Order No. 12) Order 1991 is hereby consequentially amended by omitting the items:

“1.4428 ha The following land:

(1) Section 1, S.O. Plan 58768, situated in Block III, Marotiri Survey District.

(2) Section 32, Block III, Marotiri Survey District, shown on S.O. Plan 41416.

‘531 m² Section 32, S.O. Plan 18573, situated in Block II, Lyndon Survey District. Subject to Proclamation No. 555510 (Canterbury Registry), declaring the land to be a thermal water area.

‘7880 m² Section 2, Block X, Hanmer Township, situated in Blocks I and II, Lyndon Survey District, and shown on S.O. Plan 16053. Subject to Proclamation No. 555510 (Canterbury Registry), declaring the land to be a thermal water area.”

(2) The Schedule to the State-Owned Enterprises (Landcorp Management Services Limited Vesting Order No. 18) Order 1991 (which was made on the 2nd day of March 1992) is hereby consequentially amended by omitting the item:

“‘5190 m² Section 1, S.O. Plan 14893, situated in Block IV, Gordon Survey District.’

This order vests certain Crown land in Landcorp Management Services Limited, a subsidiary of a State enterprise, on 26 March 1992. The land vested includes 5 parcels incorrectly described in previous orders; and those orders are amended by the omission of the incorrect descriptions.

Pursuant to sections 24 (1) and 28 of the State-Owned Enterprises Act 1986, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Order

1. Title and commencement—(1) This order may be cited as the State-Owned Enterprises (Landcorp Management Services Limited Vesting Order No. 11) Order 1991, Amendment No. 1.

(2) This order shall come into force on the 28th day after the date of its publication in the Gazette.

2. Deletion of incorrect legal description—The Schedule to the State-Owned Enterprises (Landcorp Management Services Limited Vesting Order No. 11) Order 1991 is hereby amended by omitting the item:

“‘1.4543 ha Section 4, Block XVI, Matakoke Survey District, shown on S.O. Plan 18275.’
