the beneficiaries of the training or scholarship shall be any New Zealander and any persons being inhabitants of islands in the Pacific Ocean but that preference will be given to descendants of members of the Maori tribes Ngati Rarua Te Atiawa and Ngati Tama.

It is also intended that the scheme should confer on the board in addition to all powers conferred upon it by law additional powers with respect to the user of the boards resources purchase of property, conduct of business, borrowing of money and provide for payment to any trustee for his or her services in connection with the administration of the trust.

The grounds of the application are:

(a) that it is impractical and/or inexpedient for the applicant to carry out the original charitable purposes of the trust;

(b) that the variations proposed in the scheme are proper and depart no further than is necessary from the provisions of the original trust;

(c) the scheme is not contrary to law or public policy or good morals;

(d) every proposed purpose of the scheme is charitable within the meaning of Part III of the Charitable Trusts Act 1957 and can be carried out;

(e) the Court will be able to exercise proper supervision of the scheme;

(f) the Attorney General’s report filed herein indicates that he is satisfied that the scheme can be approved by the Court;

(g) in all other respects the requirements of Part III of the Charitable Trusts Act 1957, have been or will be complied in respect of the scheme.

The application and scheme and report of the Attorney General have been filed in the High Court at Nelson and are open for inspection by the public without any fee or charge.

It is proposed that the application be heard by the court on the 4th day of May 1992. Any person desiring to oppose the scheme is required to give written notice of his intention to do so to The Registrar of the High Court at Nelson and to the Applicant, care of Fell & Harley, Solicitors, 204 Hardy Street, Nelson and the Attorney General, care of Solicitor General, Crown Law Office, Wellington, not less than 7 clear days before that date.
