Land Set Apart for State Highway 35, Gisborne District
Pursuant to section 52 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, Gisborne, declares the land described in the Schedule hereto, to be set apart for a road, which pursuant to section 60 (2) of the Transit New Zealand Act 1989, forms part of State Highway 35.

Right of Way Easement Acquired at Busby Hill, Gisborne District
Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, Gisborne, declares that, an agreement to that effect having been entered into, the easement described in the Second Schedule hereto, is acquired as an easement in gross over those parts of the land described in the First Schedule as are specified in the Second Schedule and shall vest in The Poverty Bay Electric Power Board (called “the grantee”) for the purposes of a radio transmitter site on the date of publication in the Gazette. Such easement may be surrendered at any time by notice published in the Gazette.

1261.5613 hectares, being part Tokomaru B3, C and F Blocks and part Tokomaru B4A, D and E Blocks, Lot 3 on Deposited Plan 2486 and Lot 6, part Lots 10 and 11 on Deposited Plan 2485 and part Lot 2 on Deposited Plan 3070, situated in Blocks III, VII and VIII, Tokomaru Survey District, comprised in certificate of title 4D/1455.

(Right of Way)
A right of way over all those pieces of land described as follows:
Part Tokomaru B2 Block; marked “A” on S.O. 8562.
Part Lot 1, D.P. 1380; marked “B” on S.O. 8562.
Part Tokomaru B4A Block; marked “C” and “D” on S.O. 8562.
S.O. 8562 is held in the office of the Chief Surveyor at Gisborne.
Additional Rights and Conditions Included in the Easement

The grantee shall not be required or empowered to fence the boundaries of the right of way.

The registered proprietor may fence across the right of way but in so doing shall erect within such fence a farm gate which will permit the passage of vehicles along the said right of way.

The use of the right of way by the grantee shall be restricted to vehicles and personnel under the control and direction of the grantee.

The grantee shall ensure that all farm gates that have been erected to permit passage along the said right of way are closed and locked after each passage of a vehicle belonging to the grantee or under the direction and control of the grantee.

Neither the grantor nor the grantee shall be required to maintain the right of way but either may, at their own expense maintain or improve the right of way to a standard sufficient for their own purposes.

Except as varied herein the rights and powers contained in the Seventh Schedule of the Land Transfer Act 1954, shall apply.

Land Acquired for Road and Road Stopped in the District of Tasman
Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Nelson:
(a) Pursuant to section 20 (1), declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for road, and pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 65 and shall vest in the Crown on the date of publication hereof in the Gazette.
(b) Pursuant to section 116 (1), declares the portions of road described in the Second Schedule hereto to be stopped.
