Notice of Intention to Take Land and Easement Over Land for Sewerage Treatment Ponds Pipeline and Leachate Control at Rawene, Under the Public Works Act 1981:
Notice is hereby given that The Far North District Council under the provisions of the Public Works Act 1981 requires to take the land described in Part A of the Schedule hereto, and take an easement over the land described in Part B of the Schedule hereto.
The first described land is required for sewerage treatment ponds and the easement for a pipeline and leachate control. It is intended to use the first described land for the treatment of sewerage within the context of the Rawene Sewerage Scheme for which purpose the land has been used since 1986, for a pipeline and to control leachate from the existing refuse site on the land secondly described. The rights and powers to be vested in The Far North District Council pursuant to the easement are to those specified in Parts 2 to 5 inclusive, of the Seventh Schedule of the Land Transfer Act 1971 and shall in addition include the power to do such other things as are required to properly control leachate from the refuse site.
The reasons why The Far North District Council considers it reasonably necessary to take these interests in the land, are as follows:
(a) The land in Part A of the Schedule has been used for purposes of sewerage treatment ponds with the consent of the occupiers of the land since 1986 but a dispute has arisen with the present owner as to ownership of the land;
(b) The land forms an integral part of the Rawene Sewerage Scheme;
(c) There is no other land which is suitable for sewerage treatment ponds within the context of the total sewerage scheme;
(d) It is in the interest of public health and the district generally that the pipeline is provided for and leachate controls are implemented in connection with the existing refuse site and the easement over land in Part B of the Schedule is required to facilitate this.
Any person having an estate or interest in the land may within twenty (20) working days after the date of publication of this notice send an objection to:
The Registrar, Planning Tribunal, Tribunals Division, Justice Department, P.O. Box 10-044, Wellington.
If any objection is made in accordance with this notice, a public hearing will be held, unless the objector otherwise requires, and each objector will be informed of the time and place of the meeting.

Schedule
North Auckland Land District
A. Land to be Acquired for Sewerage Treatment Purposes:
2.3800 hectares, being part Section 18, part of Block XIV, Mangamuka Survey District and Sections 57, 58, and 59, part of Block II, Waoku Survey District, being part of Deposited Plan 739, contained in certificate of title, Volume 46C, folio 1125 (North Auckland Registry), and more particularly described marked “A” on S.O. Plan 64643 entitled “Land Required for Sewerage Treatment Purposes”. The land is bounded on the east by the Oue-Rawene Road, and on the west by the Omania River, and is situated on the western side of the Oue-Rawene Road, approximately 1 kilometre south of Rawene Hospital.
B. Land Over Which Easement is to be Acquired for a Pipeline and for Leachate Control:
That part of the land comprised in certificate of title, Volume 46C, folio 1125, as is shown marked “B” on S.O. Plan 64643 entitled “Easement Required to Pipeline and Control of Leachate”. The land is bounded on the east by the Oue-Rawene Road, and on the west by the Omania River, and is situated on the western side of the Oue-Rawene Road, approximately 1 kilometre south of Rawene Hospital.

Pursuant to sections 24 (1) and 28 of the State-Owned Enterprises Act 1986, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
Order
-
Title—This order may be cited as the State-Owned Enterprises (Landcorp Management Services Limited Vesting Order No. 18) Order 1992.

Application—This order applies to all the land described in the Schedule to this order, saving and excepting—
(a) The bed of any lake whose bed has an area of 8 hectares or more;
(b) The bed of any river whose bed has an average width of 3 metres or more;
(c) Any land covered and uncovered by the flow and ebb of the tide at mean spring tides.
(2) In subclause (1) of this clause, the terms “bed”, “lake”, and “river” have the meanings assigned to them by section 2(1) of the Resource Management Act 1992.
- Approval and vesting—Subject to section 24 of the Conservation Act 1987, the land to which this order applies—
(a) Is hereby approved for the purposes of section 24 (1) (b) of the State-Owned Enterprises Act 1986; and
(b) On the 26th day of March 1992 shall vest for an estate in fee simple in Landcorp Management Services Limited (a company duly incorporated under the Companies Act 1955, having its registered office at Wellington, and being a State enterprise within the meaning of section 2 of the State-Owned Enterprises Act 1986),—
(i) Together with the appurtenant rights (if any) described in the Schedule to this order; but
(ii) Subject to the rights, interests, and incumbrances (if any) to which it is described in the Schedule to this order as being subject.
