Notice of Intention to Take Land for Road in Masterton District

Take notice that the Minister of Lands proposes to take under the Public Works Act 1981, the interest of Minnie Hodgson in the land described in the Schedule to this notice.

The land is required for road and it is intended to use the land for the purpose of such public work.

And notice is hereby given that the land so required to be taken is shown on a plan lodged in the office of the Chief Surveyor, Department of Survey and Land Information, Wellington, and there numbered Survey Office Plan No. 36491.

The interest in the land has not yet been taken.

Minnie Hodgson or her successor or any other person who has an estate or interest in the land has a right to object to the taking of that interest in the land.

If you wish to object you must send a written objection to the Registrar, Planning Tribunal, Tribunals Division, Justice Department, Private Bag, Postal Centre, Wellington, within 20 working days after the second publication of this notice.

If you make an objection a public hearing of the objection will be held unless you give written notice to the Tribunal that you want the hearing to be held in private.

If you make an objection:

a. you will be advised of the time and place of the hearing, and

b. you will have the right to appear and be heard personally or to be represented by a barrister and solicitor or any other person you authorise.

This notice, and the right to object described above, relate to the taking of your interest in the land and not your right to compensation. Under the Public Works Act 1981 you are entitled to full compensation, if your interest in the land is taken. If this compensation cannot be agreed between you and the Minister of Lands, it can be determined in separate proceedings before the Land Valuation Tribunal.

This notice concerns your rights over the land referred to. If you are in any doubt about its effect you should obtain legal advice immediately.

Stopped Road to be Vested and Land Severed by Road Taken in Timaru District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, Christchurch, hereby:

(a) Pursuant to sections 117 and 120, declares the parts of stopped road in the First Schedule to be vested, subject to all encumbrances set forth in the certificates of title on the date of registration in the Land Registry Office, in the following manner:

(i) Area C now known as Section 1, S.O. 18010, shall be amalgamated with the land contained in certificate of title 21K/1110.

(ii) Area D now known as Section 2, S.O. 18010, shall be amalgamated with the land contained in certificate of title 733/8.

(iii) Area E now known as Section 3, S.O. 18010, shall be amalgamated with the land contained in certificate of title 21K/1111.

(b) Pursuant to section 119, declares that the land described in the Second Schedule hereto now known as Section 4, S.O. 18010 is taken and shall be amalgamated with the land contained in certificate of title 21K/1110.
