Waimea Rural Fire District Notice 1992

Pursuant to the Forest and Rural Fires Act 1977, the National Rural Fire Authority hereby makes the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Waimea Rural Fire District Notice 1992.

(2) This notice shall come into force on the 28th day after notification in the New Zealand Gazette.

  1. Interpretation—In this notice, unless the context otherwise requires,—

“Act” means the Forest and Rural Fires Act 1977:

“Committee” means the Waimea Rural Fire Committee:

“District” means the Waimea Rural Fire District:

Constitution of the Rural Fire District

  1. Declaration of Rural Fire District—(1) The seven zones, and the areas enclosed therein specified in the Schedule to this notice, are hereby constituted and declared to be a rural fire district to be known as the Waimea Rural Fire District.

(2) The Waimea Rural Fire District shall be administered for the purpose of the Act by a rural fire committee known as the Waimea Rural Fire Committee.

(3) The committee shall consist of eleven members as follows:

(a) Two persons appointed by the Baigent Forest Industries Limited, in writing, signed on behalf of that company by one director and the secretary thereof; and

(b) Two persons appointed by Tasman Forestry Limited, in writing, signed on behalf of that company by one director and the secretary thereof; and

(c) One person appointed in writing, by the Tasman District Council; and

(d) One person appointed, in writing, by the Nelson City Council; and

(e) Two persons appointed, in writing, by the Director-General of the Department of Conservation; and

(f) One person resident in the district to represent the interests of other residents and ratepayers and appointed, in writing, by the Tasman District Council; and

(g) One person appointed, in writing, by the Federated Farmers of New Zealand (Nelson Province) Incorporated; and

(h) One person appointed, in writing, by the Chief Executive of the New Zealand Fire Service.

  1. Operations of the committee—(1) The committee shall hold an annual general meeting in August of each year.

(2) The committee shall hold a general meeting every three months.

  1. Fire officer appointments—(1) The office of the principal rural fire officer shall be appointed at the annual general meeting each year.

(2) If any committee member is appointed to the office of the principal rural fire officer the representative’s organisation may appoint a person to replace the member on the committee.

  1. Restricted fire season—The period between the 1st day of October in any one year and the 30th day of September in the following year (both days inclusive) is hereby declared to be a restricted fire season in the district.

Schedule

Nelson Land District—Tasman District and Nelson City—Waimea Rural Fire District

All that area containing 292,000 hectares, more or less, as shown by a bold black line on S.O. Plan 14966, lodged in the office of the Chief Surveyor, Nelson, and as the same on the plan numbered NRFA 108, deposited in the National Headquarters of the New Zealand Fire Service at Wellington.

Rural Fire District Revision Notice 1992

Pursuant to section 4 (4) of the Forest and Rural Fires Act 1977, the National Rural Fire Authority hereby makes the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Rural Fire District Revision Notice 1992.

(2) This notice shall come into force on the 28th day after notification in the New Zealand Gazette.

  1. Abolition of Rural Fire Districts—(1) The Maitai Roding Rural Fire District Notice 1949 (a) is hereby revoked.

(2) The Rabbit Island Rural Fire District Notice 1949 (b) is hereby revoked.

(3) The Golden Downs Rural Fire District Notice 1991 (c) is hereby revoked.

(4) The Moutere Hills Rural Fire District Notice 1959 (d) is hereby revoked and the surplus funds of the Moutere Hill Rural Fire Committee, after payment of expenses, shall be distributed as follows:

(a) Baigent Forest Industries Limited 78%

(b) Tasman District Council 5%

(c) Tasman Forestry Limited 9%

(d) Waimea Rural Fire Committee (in lieu of future administration levies imposed under section 45 of the Forest and Rural Fires Act 1977 from minor forest owners) 8%.

  1. Amendment of Rural Fire District—(1) The notice constituting the New Zealand Timberlands Rural Fire District made on 28th day of February 1992 (e) (hereinafter in this clause together with all amendment thereto, referred to as the principal notice) is hereby amended by revoking clause 5 of the notice, and substituting the following clause:

“5. The committee shall consist of five members as follows:

(a) Three persons appointed by ITT Rayonier New Zealand Limited, in writing, signed on behalf of that company by one director and the secretary thereof, and of whom one shall be appointed as chairperson; and

(b) One person appointed by the New Zealand Forestry Corporation Limited, in writing, signed on behalf of that company by one director and the secretary thereof; and

(c) One person appointed by the New Zealand Local
