Notice Controlling the Movement of Dredge or Bluff Oysters (Notice No. 5186)
For the purpose of controlling the spread of the disease Bonamia sp., a disease affecting dredge or Bluff oysters (Tiostrea chilensis)
I HEREBY GIVE NOTICE, pursuant to section 13A of the Animals Act 1967, prohibiting all or any movement of live, in-shell dredge or Bluff Oysters (Tiostrea chilensis) into each area described in the First Schedule to this notice from any other area described in the First and Second Schedules to this notice, for a period of 1 year from the date of publication of this notice in the New Zealand Gazette.
I FURTHER GIVE NOTICE, pursuant to section 13A of the Animals Act 1967, prohibiting all or any movement of live, in-shell dredge or Bluff oysters (Tiostrea chilensis) from the area described as Area 13 in the Second Schedule to this notice for a period of 1 year from the date of publication of this notice in the New Zealand Gazette.
NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS NOTICE live, in-shell dredge or Bluff oysters may be moved into the area described as Area 6 in the First Schedule to this notice if and only if the oysters are taken from the area described as Area 14 in the Third Schedule to this notice and PROVIDED THAT the oysters may only be taken:
(i) between the months of December to August inclusive; and
(ii) with the permission of the Regional Manager Central of the MAF Fisheries division of the Ministry of Agriculture and Fisheries who shall be satisfied, on the advice of a Marine Pathologist of the Fisheries Research Directorate division of the Ministry of Agriculture and Fisheries, that the oysters being moved are not affected with or do not harbour Bonamia sp.
Movement within any of the areas specified in the First, Second and Third Schedules is not prohibited.

First Schedule
Area 1:
Kermadec Islands
All that area of New Zealand fisheries waters around the Kermadec Islands enclosed by a line commencing at a point 34° 34.3' S and 179° 51.0' W on the outer limits of the exclusive economic zone; and then proceeding generally in an easterly, northerly, westerly and southerly direction along the outer limits of the exclusive economic zone to a point 34° 22.1' S and 179° 29.6' E on the outer limits of the exclusive economic zone; and then proceeding in a straight line to the first-mentioned point.
Area 2:
Tirua Point to Cape Runaway
All New Zealand fisheries waters enclosed by a line commencing at Tirua Point on the west coast of the North Island (at 38° 23' S and 174° 38.5' E); then proceeding in a straight line in a north-westerly direction to a point 37° 35' S and 170° 03' E on the outer boundary of the exclusive economic zone; then proceeding in a northerly and southerly direction along the outer boundary of the exclusive economic zone to a point 33° 25' S and 177° 59.4' E on the outer boundary of the exclusive economic zone; then in a straight line due south to Cape Runaway (at 37° 32' S and 177° 59.4' E); and then proceeding in a generally north-westerly direction along the line of the mean high-water mark to the point of commencement, and including all inland waters lying north of a straight line drawn from Tirua Point on the west coast of the North Island (at 38° 23' S and 174° 38.5' E) proceeding in a generally south-easterly direction to Mt Ngaurohoe (at 39° 09.6' S and 175° 38' E); then proceeding in a generally north-easterly direction to Mt Ruakumara (at 37° 45.9' S and 178° 07.6' E); then proceeding in a generally north-westerly direction to Cape Runaway (at 37° 32' S and 177° 59.4' E); then proceeding in a generally north-westerly and southerly direction along the line of the mean high-water mark to the point of commencement.
Area 3:
Cape Runaway to Cape Palliser
All New Zealand fisheries waters enclosed by a line commencing at Cape Runaway on the east coast of the North Island (at 37° 32' S and 177° 59.4' E); then proceeding due north to a point 33° 25' S and 177° 59.4' E on the outer boundary of the exclusive economic zone; then proceeding in a generally south-easterly direction along the outer limits of the exclusive economic zone to its intersection with the 42° 10'S parallel of latitude; then proceeding due west along latitude 42° 10'S to a point 42° 10' S and 175° 17' E; then proceeding due north to Cape Palliser on the south coast of the North Island at 41° 37' S and 175° 17' E; then proceeding in a generally north-easterly direction along the mean high-water mark to the point of commencement; and including all those inland waters east of a line commencing at Cape Runaway on the east coast of the North Island (at 37° 32' S and 177° 59.4' E) proceeding in a generally south-easterly direction to Mt Ruakumara at 37° 45.9' S and 178° 07.6' E; then proceeding in a generally south-westerly direction to Mt Ngaurohoe at 39° 09.6' S and 175° 38' E; and east of a line commencing at Mt Ngaurohoe at 39° 09.6' S and 175° 38' E; proceeding in a generally south-easterly direction to Cape Palliser on the south coast of the North Island (at 41° 37' S and 175° 17' E).
Area 4:
Cape Terawhiti to Tirua Point
All New Zealand fisheries waters enclosed by a line commencing at Cape Terawhiti on the south coast of the North Island (at 41° 17' S and 174° 37' E); proceeding due south along longitude 174° 37' E to a point 41° 43.8' S and 174° 37' E; then proceeding in a generally north westerly direction to the eastern most point of Brothers Islands at 41° 06.2' S and 174° 26.5' E; then proceeding in a north-westerly direction to the northern most point of Stephens Island at 40° 39.9' S and 174° 00' E; then proceeding north westerly to a point 37° 35' S and 170° 03' E on the outer boundary of the exclusive economic zone; then proceeding in a generally south-easterly direction along the outer limits of the exclusive economic zone to Tirua Point on the west coast of the North Island (at 38° 23' S and 174° 38.5' E); then proceeding in a generally southerly direction along the mean high-water mark to the point of commencement; and including all those inland waters south and west of a line commencing at Tirua Point on the west coast of the North Island (at 38° 23' S and 174° 38.5' E) proceeding in a generally south-easterly direction to Mt Ngaurohoe at 39° 09.6' S and 175° 38' E.
