Notice of Decision of Committee of Appeal

Notice is hereby given by the Committee of Appeal of the New Zealand Society of Accountants that it heard an appeal on 28 September 1992 by Byron Edward Paulin Wheldale of Rangiora against findings and orders made by the Disciplinary Committee on 4 August 1992.

After hearing submissions made by Byron Edward Paulin Wheldale and also by counsel on behalf of the Investigation Committee, the Committee of Appeal, pursuant to section 25 of the New Zealand Society of Accountants Act 1958, ordered that the appeal be dismissed and confirmed the orders of the Disciplinary Committee made on 4 August 1992.

The charges brought against Byron Edward Paulin Wheldale before the Disciplinary Committee on 4 August 1992 were that in terms of section 24 of the New Zealand Society of Accountants Act 1958:

(a) He had been guilty of grave impropriety in a professional respect;

(b) He had been guilty of acts and defaults discreditable to an accountant;

(c) He had conducted himself in such a manner as to render the exercise of the powers of the Disciplinary Committee expedient in the interests of the public and of the society;

and

(d) He had been guilty of unprofessional conduct.

The Disciplinary Committee found Byron Edward Paulin Wheldale guilty as charged. The Disciplinary Committee ordered that his name be removed from the Register of Members and it did not fix a date after which he may re-apply for re-registration. The Disciplinary Committee ordered him to pay to the society the sum of $22,537.37 (G.S.T. included) by way of costs. The Disciplinary Committee directed that its decision be published in the Accountants’ Journal, the New Zealand Gazette and The Press newspaper with mention of the member’s name and location.

The Committee of Appeal in dismissing the appeal and confirming the orders of the Disciplinary Committee, ordered Byron Edward Paulin Wheldale to pay to the society the sum of $6,340 (G.S.T. included) towards the costs of the appeal hearing.
