Notice of Application for Variation of the Whatman Home Trust Fund

The Charitable Trusts Act 1957

The Salvation Army Property (New Zealand) Trust Board ("the trustees") have filed in the High Court at Wellington, an application seeking an order from the Court that a scheme varying the terms of the Whatman Home Trust Fund ("the trust fund") deed be approved.

The trust fund owns certain property situated in Ngaumutawa Road adjoining the Borough of Masterton. The trust fund deed requires that the property be used to provide a children’s home for those children eligible under the trust fund deed.

Since the trust fund’s inception in 1925 the Whatman Home has provided for the care and welfare of many children. However in recent times demand for its services has declined and in 1991 there were no children in the care of the home.

The trustees do not consider that it is now appropriate to use the property as a children’s home in the manner prescribed by the trust deed.

Pursuant to the Children, Young Persons and the Families Act 1989, the environment provided by the Whatman Home is no longer consistent with contemporary social policy.

The trustees seek to amend the trust fund deed to enable the sale of the trust property. They seek to use the resulting funds to continue other day care facilities and the family care centre, and also provide financial support for the running of welfare homes for children in the Wairarapa area.

Any person intending to oppose this application must give written notice of their intention to do so to the Registrar, the Salvation Army and the Attorney-General on or before the 23rd day of November 1992.
