Survey and Land Information

Public Works Act 1981

Road Realignment in Otorohanga District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Otorohanga District Council.

(b) Pursuant to section 116, declares the pieces of road described in the Second Schedule hereto to be stopped.

(c) Pursuant to section 117, declares that:

(i) The area of stopped road firstly described in the said Second Schedule, now known as Section 1, S.O. 38658, shall be amalgamated with the land in certificate of title, Volume 645, folio 100, subject to memorandum of mortgage H. 737013, South Auckland Land Registry.

(ii) The area of stopped road secondly described in the said Second Schedule, now known as Section 2, S.O. 38658, shall be amalgamated with the land in certificate of title No. 45A/709, subject to memoranda of mortgage H. 934386.2 and H. 934386.3, South Auckland Land Registry.

(iii) The areas of stopped road thirdly, fourthly, sixthly and eighthly described in the said Second Schedule, now known as Sections 3, 4, 6 and 8, S.O. 38658 respectively, shall be amalgamated with the land in certificate of title, Volume 645, folio 104, subject to memorandum of mortgage H. 737013, South Auckland Land Registry.

(iv) The areas of stopped road fifthly and eighteenthly described in the said Second Schedule, now known together as Section 5, S.O. 38658, and the areas seventhly and seventeenthly described, now known together as Section 7, S.O. 38658, and the area ninthly described, now known as Section 9, S.O. 38658, shall be amalgamated with the land in certificate of title, Volume 645, folio 103, subject to memorandum of mortgage H. 938430.3, South Auckland Land Registry.

(v) The areas of stopped road tenthly to sixteenthly described, inclusive, in the said Second Schedule, now known as Sections 10, 11, 12, 13, 14, 15 and 16, S.O. 38658 respectively, shall be amalgamated with the land in certificate of title, Volume 2010, folio 37, subject to memorandum of mortgage H. 737013, South Auckland Land Registry.
