Right of Way

A right of way over all those pieces of land described as follows:

Part Tokomaru B1 Block; marked “E” on S.O. 8562.

Part Mangahauini 7, Section 137A Block; marked “F” on S.O. 8562.

S.O. 8562 is held in the office of the Chief Surveyor at Gisborne.

Additional Rights and Conditions Included in the Easement

1. The grantee shall not be required or empowered to fence the boundaries of the right of way.

2. The registered proprietor may fence across the right of way but in so doing shall erect within such fence a farm gate which will permit the passage of vehicles along the said right of way. The cost of supplying and erecting the farm gate shall be shared equally by the grantor and grantee.

3. The use of the right of way by the grantee shall be restricted to vehicles and personnel under the control and direction of the grantee.

4. The grantee shall ensure that all farm gates that have been erected to permit passage along the said right of way are closed and latched after each passage of a vehicle belonging to the grantee or under the direction and control of the grantee.

5. Neither the grantor nor the grantee shall be required to maintain the right of way but either may, at their own expense maintain or improve the right of way to a standard sufficient for their own purposes.

6. The grantee shall be entitled to deviate from the defined right of way to the extent that may be necessary from time to time by reason of topographical features making it impracticable to adhere to the defined line of right of way.

7. Should the right of way interfere with any change of farming practice introduced by the registered proprietor the grantee will co-operate in all reasonable ways with the registered proprietor to alleviate the effects of the interference.

8. Except as varied herein the rights and powers contained in the Seventh Schedule of the Land Transfer Act 1954, shall apply.

Amending a Notice Declaring Crown Land to be Taken for the Development of Water Power (Stoke Substation) in the City of Nelson

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Nelson, hereby amends the notice dated the 21st day of August 1992, and published in the New Zealand Gazette of 27 August 1992, No. 134, at page 2905, declaring Crown land to be taken for the development of water power (Stoke substation), by omitting from the heading and the fifth line the word

“taken”

and substituting the words

“set apart”.

Land Acquired for Road and Land Acquired for the Purposes of a Road in the District of Tasman

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Nelson:

(a) Pursuant to section 20 (1) of the Public Works Act 1981, and section 88 (2) of the Transit New Zealand Act 1989, declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for limited access road, which has become road, limited access road and State highway, and shall vest in the Crown on the date of publication hereof in the Gazette.

(b) Pursuant to section 20 (1), declares that, an agreement to that effect having been entered into, the land described in the Second Schedule hereto is hereby acquired for the purposes of a road and shall vest in the Crown on the date of publication hereof in the Gazette.

First Schedule

Nelson Land District—Tasman District

134 square metres, situated in Block IX, Waimea Survey District, being part Lot 1, D.P. 12689; as shown marked “A” on S.O. Plan 14923, lodged in the office of the Chief Surveyor at Nelson.

Second Schedule

Nelson Land District—Tasman District

333 square metres, situated in Block IX, Waimea Survey District, being part Lot 5, D.P. 11885; as shown marked “B” on S.O. Plan 14923, lodged in the office of the Chief Surveyor at Nelson.
