Education Act 1989

Education (Domestic Students) Notice 1992

Pursuant to section 159 of the Education Act 1989, the Minister of Education hereby gives the following notice:

Notice

  1. Title and commencement—(1) This notice may be cited as the Education (Domestic Students) Notice 1992.

(2) This notice shall come into force on the 28th day after the date of its publication in the Gazette.

  1. Interpretation—In this notice unless the context otherwise requires—

“Institution” has the same meaning as stated in section 159 of the Education Act 1989.

  1. Certain persons to be treated as if they are not foreign students—For the purposes of Parts XIII to XXIV of the Education Act 1989, and the Thirteenth to the Eighteenth Schedules to that Act, persons of the following class or description of persons are required to be treated as if they are not foreign students:

(a) Persons who are in New Zealand to study under an exchange scheme approved by the Government; and

(b) Persons who are in New Zealand to study under an exchange scheme approved by the Council of the institution at which the person is, or is to be, enrolled.

Note: The effect of this notice is that foreign tertiary students in New Zealand on approved exchange schemes are to be treated for enrolment, course, and fee purposes as if they were domestic students.
