the 31st day of August, the membership and the basis of election of the council; and

(b) Section 23 of the Local Government Amendment Act 1991 provides that notwithstanding anything in section 101H of the Local Government Act 1974, a council may resolve, before the 1st day of August 1991, not to undertake a review of its membership and the basis of the election, prior to the triennial general election of the Council to be held in 1992; and

(c) The Kaikoura District Council resolved on the 20th day of November 1991 not to undertake a review, and that its membership and basis of election on which it is to be elected at the 1992 elections shall remain as specified in the Order in Council constituting the Council; and

(d) It is desirable to validate the late passage of the resolution:

Now therefore, pursuant to section 719 of the Local Government Act 1974, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Order

1. Title and commencement—(1) This order may be cited as the Kaikoura District Council Review of Membership and Basis of Election (Late Passing of Resolution) Validation Order 1992.

(2) This order shall come into force on the day after the date of its publication in the Gazette.

2. Validation of late resolution—The making of the resolution referred to in the Preamble to this order, after the date required by section 23 of the Local Government Amendment Act 1991, is hereby validated.
